HomeMy WebLinkAboutBy-law 2446/87THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2446 /87 Being a by-law to authorize the execution of a Transfer from The Corporation of the Town of Pickering to Kenneth Paul Reid and Leona Vera Reid, respecting Part Lot 10, Plan 221, Pickering, designated as Part 43, Plan 40R-4433 (Sheppard Avenue). WHEREAS the Corporation of the Township of Pickering (of which The Corporation of the Town of Pickering is the successor) is the owner of certain lands in Part Lot 10, Plan 221, Pickering, designated as Part 43, Plan 40R-4433; and WHEREAS those lands are no longer required for the purposes of the Corporation, the lands having been stopped up as public highway by By-law 1097/80, enacted April 8, 1980, and registered as Instrument No. D106177 on April 14, 1980; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Transfer, in the form attached hereto as Schedule A, of Part Lot 10, Plan 221, Pickering, designated as Part 43, Plan 40R-4433, between The Corporation of the Town of Picketing and Kenneth Paul Reid and Leona Vera Reid, the owners of the lands immediately adjacent, on the north side, of the lands referred to above. The Mayor and Clerk are hereby authorized to execute an Indemnification Agreement, in the form attached hereto as Schedule B, between Kenneth Paul Reid and Leona Vera Reid and The Corporation of the Town of Picketing, respecting the indemnification of the Town for any utility relocation costs which may be incurred as a result of the Transfer referred to in section 1. BETWEEN: THE CORPORATION OF THE TOWN OF PICKERING, (hereinafter called the "Town") OF THE FIRST PART, - and - KENNETH PAUL REID and LEONA VERA REID (hereinafter collectively called the "Owner") OF THE SECOND PART. WHEREAS, by Instrument dated , 1987 and registered Office for the Registry Division of Durham as Instrument No. conveyed to the Owner certain land in the Town of Picketing; in the Registry , the Town has NOW THEREFORE, THIS AGREEMENT WITNESSETH conveyance by the Town to the Owner of that land herein, the Parties hereto agree as follows: THAT, in consideration of the and of the covenants contained The land affected by this Agreement (herein called the "Land") is that part of Lot 10, Plan 221, Picketing, designated as Part 43, Plan 40R-4433. The Owner shall save harmless and indemnify the Town from and against all claims and demands in respect of the conveyance by the Town to the Owner of the Land, and from and against all losses, damages, costs, charges and ex- penses which the Town may sustain or incur as a result of the location or re-location of any public or quasi-public utility or service necessitated _by, caused by, or resulting in any way from the above-mentioned conveyance. This Agreement and everything contained herein shall enure to the benefit of and be binding upon the Parties hereto and their respective heirs, administra- tors, successors and assigns. IN WITNESS WHEREOF, the individuals comprising the Party of the First Part have hereunto set their hands and seals and the Party of the Second Part has hereunto affixed its corporate seal, duly authorized by its proper officers.
