HomeMy WebLinkAboutBy-law 2370/87THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2370/87 Being a by-law to authorize the execution of a Release of an Agreement dated August 15, 1977 between Elvin Construction Ltd. and The Corpo- ration of the Town of Picketing respecting Lots 82, 83 and Part Lot 84, Plan 350, Piekering. WHEREAS, on August 15, 1977, The Corporation of the Town of Pickering entered into an agreement with Elvin Construction Ltd. which agreement was subsequently registered in the Whitby Land Registry Office on January 29, 1979, as Instrument No. D84292, respecting the development of Lots 82, 83 and Part Lot 84, Plan 350, Picker- lng; and WHEREAS, it is now deemed expedient to release Elvin Construction Limited from the provisions of that Agreement; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are h.~reby authorized to execute a Release, in the form attached hereto as Schedule A, of an Agreement dated August 15, 1977 between Elvin Construction Ltd. and The Corporation of the Town of Pickering respect- ing the development of Lots 82, 83 and Part Lot 84, Plan 350, Pickering. BY-LAW read a first, second and third time and finally passed this 2nd day of Feb- ruary, 1987. ~/J~hh E. Ande~rson, Mayor /Br~ce Taylor, Clerk' TOWN OF PICKERING APPRO¥ -D RELEASE In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING hereby releases and forever discharges ELVIN CONSTRUCTION LTD. its heirs, executors, administrators, successors and assigns of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to an Agreement dated August 15, 1977 and registered in the Land Registry Office for the Registry Division of Durham on January 29, 1979 as Instrument No. D84292 between THE CORPORATION OF THE TOWN OF PICKERING and ELVIN CONSTRUCTION LTD. concerning the lands more particularly described in Schedule "A" attached hereto. IN WITNESS WHEREOF The Corporation of the Town of Picketing has hereunto affixed its corporate seal attested by its properly authorized officers this 2nd day of February, 1987. Anderson, Mayor Bruce Taylor, Clerk SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Picketing, in the Regional Municipality of Durham (formerly in the Township of Picketing, in the County of Ontario) and being the whole of Lots 82 and 83 as shown on Registered Plan No. 350 registered in the Registry Office at Whitby for the Registry Division of Durham (No. 40) (formerly of the County of Ontario); AND being part of Lot 84 as shown on the said Plan No. 350 and being more particu- larly described as follows: COMMENCING at the southeasterly angle of said Lot 84; THENCE westerly along the southern boundary of the said Lot four hundred feet (400') more or less to the southwest angle of said Lot 84; THENCE northerly along the western boundary of said Lot forty-two feet (42') to a point. THENCE easterly in a line parallel to the southern boundary of said Lot four hundred feet (400') more or less to a point in the eastern boundary of said Lot and the west- ern limit of Rosebank Road said point being forty-two feet (42') northerly of the said southeasterly angle; THENCE southerly along the eastern limit of said lot and the western limit of Rosebank Road forty-two feet (42') to the place of beginning. SAVE AND EXCEPT part of Lot 83 as shown on Registered Plan No. 350 registered in the Registry Office at Whitby for the Registry Division of Durham (No. 40) now designated as Part 2 on plan deposited in the said Registry Office as No. 40R-3176. AS DESCRIBED in Instrument No. D84292.
