HomeMy WebLinkAboutBy-law 2079/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2079 /85 Being a by-law to authorize the execution of an agreement postponing mortgage between Bank of Montreal and The Corporation of the Town of Picketing, respecting part Lots 64-71, Plan 418, Pickerlng (Draft Plan 18T-80006, Revised) WHEREAS, by By-law 1874184, enacted 3uly 3rd, 1984, the Council of The Corpo- ration of the Town of Picketing authorized the execution of a subdivision agreement between Rulor Developments Limited and The Corporation of the Town of Picketing respecting part Lots 64-71, Plan 418, Picketing (Draft Plan 18T-80006, Revised); and WHEREAS, it is necessary to enter into an agreement postponing mortgage held by Bank of Montreal on those lands in order to protect the Town's interest in those lands arising from that subdivision agreement; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an agreement postponing mortgage, in the form attached hereto as Schedule A between Bank of Montreal and The Corporation of the Town of Picketing respecting the subdivision agree- ment between the Town and Rulor Developments Limited controlling the develop- ment of part of Lots 64-71, inclusive, Plan 418, Picketing (Draft Plan 18T- 80006, Revised). The Bank hereby postpones the said Mortgage and any rights or interest which the Bank has in the land described in Box (6) in f~vour of the said Agreement to the inient that the said Agreement shall take effect as though executed (3nd registered prior to the execution and registratio of the said Mortgage.
