HomeMy WebLinkAboutBy-law 2046/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2046/85 Being a by-law to authorize the execution of a Release of Section 5 of Schedule A of the Sub- division Agreement between J. F. Coughlan Construction Co. Limited and the Corporation of the Town of Pickering respecting Plan 40M-1304. WHEREAS, pursuant to the provisions of section 5, Schedule A of the subdivision agreement dated July 4th, 1983, between J. F. Coughlan Construction Co. Limited and the Corporation of the Town of Pickering respecting the development of Plan 40M-1304, Block 31 is to be held as a future development block; and WHEREAS, Block 31 is being developed in conjunction with adjacent lands and should therefore be released from the provisions of the said section 5; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule A, of Section 5, Schedule A of the Subdivision Agreement dated July 4th, 1983, between J. F. Coughlan Construction Co. Limited and the Corporation of the Town of Picketing respecting Plan 40M-1304. Schedule A RELEASE & DISCHARGE WHEREAS, by Agreement dated July 4th, 1983, Notice of which February 9th, 1984, in the Land Titles Office for the Registry (No. 40) as Instrument No. LT196556, between was registered on Division of Durham J. F. COUGHLAN CONSTRUCTION CO. LIMITED hereinafter referred to as the "Owner". and THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the TrTown". the Owner made certain covenants and agreements with the Town relating to the subdivision and development of the lands described in Schedule A hereto, NOW THEREFORE, in consideration of the payment of the sum of $5.00 bv or on behalf of the Owner to the Town, receipt of which is by the Town hereby acknowl- edged, the Town hereby remises, releases and forever discharges the Owner and its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind which the Owner may have been, is or may otherwise become subject to pursuant to the provisions of section 5 of Schedule A of the said Agreement. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal duly attested by its proper officers. DATED at Picketing this 17th day of June, 1985.
