HomeMy WebLinkAboutBy-law 1992/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1992 /85 Being a by-law to authorize the execution of a Release by the Corporation of the Town of Picketing of William Arthur Leslie and Norma Shirley Leslie from the financial covenants con- tained in a Deed respecting Part Lot 33, Conces- sion 3, Picketing (Part 3, Plan 40R-6295) WHEREAS, Committee of Adjustment Application C 39/66 imposed a condition requiring the payment of a lot development fee, which condition appeared in the property Deed; and WHEREAS that condition was satisfied on July 14th, 1970 by the payment of the subject fee; and WHEREAS it is now deemed expedient to release the financial covenants contained in the subject Deed; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule A, of William Arthur Leslie and Norma Shirley Leslie respecting financial covenants contained in a Deed respecting Part Lot 33, Concession 3, Picketing (Part 3, Plan 40R-0295). BY-LAW read a first, second and third time and finally passed this lSth day of March, 1985. Clerk pro tempo~e RELEASE In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING as successor to The Corporation of the Township of Picketing hereby releases and forever discharges WILLIAM ARTHUR LESLIE and NORMA SHIRLEY LESLIE their heirs, executors, administrators, successors and assigns of and from all claims, demands, damages, actions or 'causes of action which may have existed, now exist, or may exist as a result of or in any way related to any claim for payment to the Township (now Town) of Picker- lng referred to in a Deed dated September 2nd, 1966 and registered as Instrument No. 145483 on September 13th, 1966 between EDMUND HENRY KAZMAREK and RENEE MARIE LOUISE KAZMAREK (as Grantors) and WILLIAM ARTHUR LESLIE and NORMA SHIRLEY LESLIE (as Grantees) concerning the lands more particularly described in Schedule A attached hereto. IN WITNESS WHEREOF the Corporation of the Town of Pickering has hereunto affixed its corporate seal, attested to by its properly au- thorized officers this 18th day of March, ]985. SIGNED, SEALED & DELIVERED TttE CORPORATION OF THE TOWN OF PICKERING Mayor Clerk SCHEDULE A ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering in the Regional Munic- ipality of Durham and Province of Ontario (formerly Township of Picker- lng, County of Ontario) and being composed of part of the northerly part of Lot Number 33, in the Second Concession of the said Town, described as follows: COMMENCING at a point in the south limit of the road allowance between Concessions 2 and 3, distant three hundred and four feet (304') measured easterly therealong from the westerly limit of said Lot 33; THENCE EASTERLY along the southerly limit of the road allowance between Concessions 2 and 3, a distance of three hundred and six- ty-four feet nine inches (364'-9") to a point; THENCE SOUTHERLY parallel to the easterly limit of said Lot 33 a distance of three hundred and sixty feet (360') to a point; THENCE WESTERLY parallel to the southerly limit of the road allowance between Concessions 2 and 3, a distance of three hundred and six- ty-four feet nine inches (364'~9") to a point distant three hundred and four feet (304') easterly from the westerly limits of said Lot 33; THENCE NORTHERLY parallel to the westerly limit of said Lot 33 a distance of three hundred and sixty feet (360~) to the PLACE OF BEGIN- NING; AS DESCRIBED in Instrument No. 145483.
