HomeMy WebLinkAboutBy-law 1974/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1974/85 Being a by-law to authorize the execution of a Future Development Agreement between The Corporation of the Town of Picketing and Bruce McDowell, in Trust, respecting part Lot 19, Concession 9 and part road allowance between Lots 18 and 19, Concession 9 (Parts 1 and 2, Plan 40R-4867, except Parts 1, 2 and 3, Plan 40R-7923), (LD 283, 284 and 285/83). WHEREAS, by Decisions dated February 27th, 1984, the Land Division Committee of the Regional Municipality of Durham approved Applications LD 283/83, 284/83 and 285/83, respecting the severance of three building lots, subject to certain conditions, one of which requires that the future development of the retained lands be by plan of subdivision only; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Future Development Agreement between The Corporation of the Town of Pickering and Bruce McDowell, in Trust, respecting part Lot 19, Concession 9 and part road allow- ance between Lots 18 and 19, Concession 9 (Parts I and 2, Plan 40R-4867, except Parts 1, 2 and 3, Plan 40R-7923), (LD 283/83, 284/83 and 285/83). BY-LAW read a first, second and third time and finally passed this 18th day of February, 1985. rk ' THIS AGREEMENT made February 18th, 1985. BETWEEN: THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE FIRST PART, - and - BRUCE McDOWELL, IN TRUST hereinafter called the "Owner" OF THE SECOND PART. WHEREAS, by decisions dated February 27th, 1984, the Land Division Committee of the Regional Municipality of Durham approved Applications LD 283/83, 284/83 and 285/83, respecting the severance of three building lots subject to certain conditions; and WHEREAS one of the conditions requires that the retained lands be developed only by plan of subdivision; NOW THEREFORE, THIS AGREEMENT WITNESSETH THAT, in consideration of the sum of $2.00 now paid by each Party to the other, receipt of which by each is hereby acknowledged, the Parties hereto agree as follows: The lands affected hereby, the "subject lands", are those lands more particu- larly described in Schedule A hereto. The Owner of the subject lands shall not apply for, nor permit or cause any other person to apply for, a permit to construct any building or structure to be located on the sUbject lands and to which the Ontario Building Code, or any successor thereto, as amended from time to time, applies, unless the subject lands have first been included in a plan of subdivision pursuant to the Planning Act, 1983, or any successor thereto, as amended from time to time, which plan has been registered after the date hereof in the Land Registry Office for the Land Titles Division of Durham (No. 40). Whenever in this Agreement a singular noun, pronoun or verb is used, it shall be read and construed as including the plural thereof. This Agreement and everything herein contained shall enure to the benefit of and be binding upon the Parties hereto, their respective heirs, executors, administrators, successors and assigns. IN WITNESS WHEREOF, the Town has hereunto affixed its corporate seal duly attested by its authorized officers, and the Owner has hereunto affixed his hand and seal.
