Approval of Minutes Moved by C. Doody-Hamilton Seconded by J. White That the Heritage Pickering Advisory Committee Meeting Minutes of February 28, 2024 be approved. Delegations 4.1 Chris Uchiyama, LHC Heritage Planning & Archaeology Re: Part IV Designation of 301 Kingston Road Chris Uchiyama, LHC Heritage Planning & Archaeology spoke to the Heritage Impact Assessments conducted for 301 Kingston Road, and that the latest assessment does not recommend the designation based on the structures current condition. A question and answer period ensued between the Committee and Ms. Uchiyama regarding: • concerns regarding the scope of the first assessment being focused on what material could be salvaged rather than whether the property should be designated; • whether it was possible to determine the amount of damage that occurred while under ownership of the current owner; • clarification regarding the Committee’s past discussions on the 301 Kingston Road property; • concerns regarding the time constraints around a decision to designate; • concerns around the potential demolition of the building and the loss of cultural heritage value; • changes made to the features of the property between 2022 and 2023; • clarification that LHC Heritage does not recommend designation of the building at 301 Kingston Road; • clarification that designation would prevent the demolition of the structure and require heritage permits to be issued to perform any work on the building; and, • clarification that the structure is the only two-storey Georgian type building in Pickering. 4.2 Iain Donnell, Donnell Law Group Re: Part IV Designation of 301 Kingston Road Iain Donnell, Donnell Law Group provided comments on behalf of the owner, indicating that the City and the owner have differing ideas of Page 3 of 5 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) commemorating the heritage value of the property. He stated that while he understood the concerns raised, he questioned the value of designation of the building which had been considerably modified. A question and answer period ensued between the Committee and Mr. Donnell regarding: • clarification that the owner would require a permit to make changes and alterations to the building if designated; • clarification regarding the cost figures provided by Clark Engineering in the Report; • clarification that the designation would apply to the home in its current condition; • clarification regarding the opportunity to incorporate heritage materials and recognition into any new structure on the site; • clarification that the designation of the house would not prohibit the owner from building elsewhere on the property; • concerns regarding the property continuing to sit in its current condition; • whether it was possible to place a covenant on the land to force the owner to implement heritage design elements on the property in the future; • concerns regarding the timelines imposed by the owner through the application for a demolition permit; • concerns regarding the significant cost to restore the building; • clarification regarding the client’s intention with the property; and, • whether the client would be willing to withdraw the latest demolition permit application to continue working with the City. 5. New Business 5.1 Part IV Designation of 301 Kingston Road Page 4 of 5 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) Game provided an overview of Memorandum provided regarding the Part IV Designation of 301 Kingston Road and indicated that the City identifies this building as a valuable Heritage resource. Discussion ensued amongst the Committee regarding: • clarification regarding the current ownership of the property since 2016; • the differing opinions offered by the Reports regarding the structural integrity of the building; • potential scenarios that could occur if heritage designation is applied; • the Notice of Intention to Designate and appeal process that would occur should Council resolve to designate the building; • whether there are other options that can be considered to incorporate heritage elements into any potential future development on the site; and, • concerns regarding the potential for ongoing neglect of the property. Moved by C. Doody-Hamilton Seconded by A. Bhadra 1. That Heritage Pickering refuse the “Request for Demolition” of the house at 301 Kingston Road based on its cultural heritage value or interest; 2. That the property at 301 Kingston Road be designated under Part IV of the Ontario Heritage Act; and, 3. That the recommendations of the Heritage Pickering Advisory Committee be forwarded to Council for their consideration. Carried 6. Other Business There was no other business.
