HomeMy WebLinkAboutBy-law 2227/86THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 2227/86 Being a by-law to authorize the construction of a roadway, including curbs, paving, sidewalks, boulevard sodding and tree planting, as a local improvement under the provisions of sections 7.1(a), 11 and 68 of the Local Improvement Act. Whereas it is deemed expedient that the petition for roadway construction, including curbs, paving, sidewalks, boulevard sodding and tree planting, to extend Pickering Parkway from its easterly terminus to Notion Road be granted and that the construction thereof shall be undertaken at the cost hereinafter set out as a local improvement under the provision of section 11 of the Local Improve_~ent Act; and Whereas the cost of the said works is to be levied by imposing a special assessment against lands fronting on the proposed roadway to be known as Pickering Parkway pursuant to section 68 of the Local Improvement Act; Now Therefore the Council of the Corporation of the Town of Pickering hereby enacts as follows: 1. (1) That a roadway, including curbs, paving, sidewalks, boulevard sodding and tree planting be constructed from the easterly terminus of Pickering Parkway, 756 metres easterly to Notion Road at an estimated cost of $490,000.00 as a local improvement under the provisions of the Local Improvement Act. (2) The entire cost of the works referred to in subsection (1) shall be specially assessed upon land abutting directly on the works and immediately benefitting therefrom. The entire cost including debenture charges, shall be assessed and levied against those properties shown on Schedule "A" attached hereto. The firm of Fred Schaeffer and Associates Limited is hereby authorized to make such plans, profiles and specifications and furnish such plans and information as may be necessary for the making of contracts for doing the works or for carrying out the sane, and the works shall be carried on and executed under the superintendence and accordance to the direction and orders of the Engineer of the Corporation of the Town of Pickering. The cost of the works, estimated at $490,000.00 is to be paid by the issuing of debentures bearing interest at the rate of eleven (11) per cent~m% and is to be repaid by the special assessments over a term of ten (10) years. The Treasurer may, subject to the approval of Council, agree with any bank or person for temporary advances of m~ney to meet the cost of the works pending completion thereof. Any person whose land is specially assessed may coranute, by a payment in cash, the special rate ~mposed by paying the cost of construction assessed upon such land without interest until the special assessment roll has been certified by the Clerk, and with interest as set out in Section 3, both c~u~uted at the rate of three per cent below bank prime on the day of con*nutation, after the special assessment roll has been certified by the Clerk. 6. This by-law shall not come into effect until the approval of the Ontario Municipal Board to the undertaking herein is obtained. BY-LA~ READ a first and second time this 20th day of {~ay, 1986.
