BY-LAW NO. 3464/90
Being a by-law to stop-up and sell part of mad allowance
between Lots 24 and 25, Concession 1, Pickering (Part Part
3, Plan 40R-11483, being Part 1, M.T.C. Plan P-1922-271)
(Dixie Road)
WHEREAS, pursuant to the provisions of sections 298.(1) and 316(1) of the .Municipal Act,
R.S.O. 1980, chapter 302, the Council of the Corporation of the Town of Plckering passed
By-law 2799/88 on August 2, 1988 to stop-up part of the road allowance between Lots 24 and
25, Concession 1, Pickerin$, being Part 3, Plan 40R-11483 and to authorize its sale to the
abutting owner at a fixed price; and
WHEREAS, pursuant to the provisions of section 24(3) of the Public Transportation and
Highway Improvement Act, R.S.O. 1980, chapter 42.1, on September 20, 1988, the Provincial
Minister of Transportation consented to the road closing effected by By-law 2799/88; and
WHEREAS, at the t!me the Minister consented to that road closing, a portion, of.the lands
affected thereby, being Part 1 on Ministry of Transportation and Commumcatlons Plan
P-1922-271, were still under the jurisdiction and control of the Ministry of Transportation and
Communications; and
WHEREAS, pursuant to section 29(4) of the Public Transportation and Highway Improvement
Act, on July 27, 1989, the Lieutenant Governor in Council made Order in Council O.C.
1926/89 transferring Part 1 o.n Ministry .of Transportation and .Communications Plan
P-1922-271 to the Tow. n of Pickenng and vesting same in and under the jurisdiction and control
of the Town of Pickerlng on and after that date; and
WHEREAS, pursuant to theprovisions of sections 298(1) and 316(1) of the Municipal Act it is
necessary for the Council of The Corporation of the Town of Pickering to enact a further
by-law to stop-up that part of t. he highway transferred by Order in Council O.C. 1926/89 and
authorizing its sale at a fixed puce;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. That part of the road allowance between Lots 24 and 25, Concession 1, Picketing,
designated as Part 1, on Ministry of Transportation and Communications Plan
P-1922-271 attached to Inst. mment No. D321155 (registered August 24, 1989), is
stopped-up and closed to vehicular and pedestrian traffic.
2. The lands described in section 1 shall be offered for sale to the abutting owner at a
price fixed at $2.00 which offer shall be made by the Town on or before June 22, 1990.
3. The period within which an abutting owner may exercise his right to purchase the
portion of the lands described in section 1 that abut his lands shall commence at 9:00
a.m. on June 1, 1990 and end at 4:00 p.m. on June 29, 1990.
BY-LAW read a first and second time this 28th day of May, 1990;
BY-LAW read a third time and finally passed this 18th day of June, 1990.

Pursuant to the authority delegated to me by the Minister of
Transportation, I consent to the road closing affected by
By-Law No. 3464/90 of the Town of Pickering in accordance with
Subsection 24(3) of the Public Transportation and Highway
Improvement Act R.S.O. 1980 Chpt. 421 as amended.
