Being a by-law to authorize the execution o! an Agreement
to amend the Development Agreement respecting Lots 21
and 22, Concession I, Picketing (Discovery Place/Citadel)
WHEREAS Duffin Developments Inc., Discovery Place Limited and The Corporation of the
Town of Picketing entered into a Development Agreement dated January 19, 1987 (Notice of
which was registered September 9, 1987, as Instruments No. D259811 and LT348800) requiring
the development of part of Lots 21 and 22, Concession 1, Picketing, to be undertaken in
accordance therewith, which Agreement requires amendment in a certain respect;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Agreement in the form
attached hereto as Sched..ule A, amending the Development Agreement dated January
19, 1987, between Duffin Developments Inc., Discovery Place Limited and The
Corporation of the Town of Picke.rmg, respecting the development of part of Lots 21
and 22, Concession 1, Picketing (Discovery Place/Citadel).
BY-LAW read a first, second and third time and finally passed this 7th day of May, 1990.

to amend the Development Agreement respecting Lots 21
and 22, Concession 1, Picketing (Discovery Place/Citadel)
WHEREAS Duffin Developments Inc., Discovery Place Limited and The Corporation of the
Town of Pickering entered into a Development Agreement dated January 19, 1987 (Notice of
which was registered September 9, 1987, as Instruments No. D259811 and LT348800) requiring
the development .of part of Lots 21 and 2.2, Concession 1, Pickering, to be undertaken in
accordance therewith, which Agreement reqmres amendment in a certain respect;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Agreement in the form
attached hereto as Schedule A, amending the Development Agreement dated January
19, 1987, between Duffin Developments Inc., Discovery Place Limited and The
Corporation of the Town of Pickermg, respecting the development of part of Lots 21
and 22, Concession 1, Picketing (Discovery Place/Citadel).
BY-LAW read a first, second and third time and finally passed this 7th day of May, 1990.

THIS AGREEMENT made May 7, 1990,
BETWEEN:
DISCOVERY PLACE LIMITED
herein called the "Owner"
OF THE FIRST PART,
THE CORPORATION OF THE TOWN OF PICKERING
herein called the "town"
OF THE SECOND PART.
WHEREAS Duffin Developments Inc. (of which the .Ovyner is the successor in title to the lands
affected hereby), the Owner and the Town entered into a Development Agreement dated
January 19, 1987, (Notice of which was registered September 9, 1987, as 13strument:s. No.
D259811 and LT348800) requiring the development of part of Lots 21 and 22, Concession 1,
Picketing, to be undertakenin accordance therewith, whmh Agreement requires amendment in
a certain respect;
NOW THEREFORE THIS AGREEMENT WITNESSETH, that in consideration of the sum of
$2.00 now paid by each Party to the other, receipt of which by each is hereby acknowledged, the
Parties hereto covenant and agree one with the other as follows:
1. The lands affected by this Agreement (the "Lands") are those parts of Lot 21, Concession 1,
Pickering, designatedas Parts I0 and 11, Plan 40R-10070.
2. In this Agreement, "Development Agreement' means the Agreement between Duffin
De.velopments Inc., the Owner and the Town dated January 19, 1987 (Notice of which was
registered September 9, 1987, as Instruments No. D259811 and LT348800).
3. The ...Owner and the Town acknowledge and agree that they are bound by the terms and
conditions of the D,.evelopment Agreement and shall continue to be bound by it, as
amended hereby, as It affects the Lands herein only.
4. Schedule A to the Development Agreement is deleted and the Schedule attached hereto is
substituted for it.
IN WITNESS WHEREOF, the pa?ies h.ereto have hereunto affixed their corporate seals,
attested by the hands of their authorized officers.
