HomeMy WebLinkAboutBy-law 3442/90 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3442/90 Being a by-law to authorize the execution of a Release of an Agreement respecting Part Lot 22, Concession 2, Picketing (Joe L. Klesits and Louis Rotter). WHEREAS it is necessary to remove from title an Agreement between the Town and Joe L. Klesits and Louis Rotter dated November 16, 1971 and registered November 22, 1971, as Instrument No. 216859; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: I. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule A, of an Agreement dated November 16, 1971 and registered November 22, 1971 as Instrument No. 216859 respect- ing Part Lot 22, Concession 2, Picketing (Joe L. Klesits and Louis Rotter). BY-LAW read a first, second and third time and finally passed this 2nd day of April, 1990. Wayne rtl~urs, ayor ~ PtCKERING APPROVED LEGAL DEP~ SCHEDULE A ALL AND SINGULAR that certain parcel or tract of land and premises, situate, lying and being in the Township of Pickering in the County and Province of Ontario, being composed of part of Lot 22, in the 2nd Concession of the said Township, said parcel or tract containing by admeasurement five (5) acres more or less, and may be more particularly described as follows: COMMENCING at the intersection of an old fence marking the centre line of said Lot 22 with the southerly limit of said Lot 2:~; THENCE NORTHERLY in and along the said fence marking the said centre line a distance of six hundred and sixty feet (660'} to a point; THENCE WESTERLY parallel with the said southerly limit of Lot 22, a distance of three hundred and thirty feet (330') to a point; THENCE SOUTHERLY parallel with the existing centre line of Lot 22, a distance of six hundred and sixty feet (660') to a point in the said southerly limit of Lot 22, distant westerly three hundred and thirty feet (330") from the place of beginning. THENCE EASTERLY a distance,of three hundred and thirty feet (330') in and along the said southerly limit to the place of beginning. RELEASE In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING, (as successor to The Corporation of the Township of Pickering) ~ereby releases and forever discharges JOE L. KLESITS and LOUIS ROTTER heir heirs, executors, administrators, successors and assigns, of and from all claims, ]emands, damages, actions or causes of action which may have arisen, are arising, or nay arise as a result of or in any way related to an Agreement dated November 16, 971, and registered as Instrument No. 216859 on November 22, 1971, between THE CORPORATION OF THE TOWNSHIP OF PICKERING and JOE L.
