HomeMy WebLinkAboutBy-law 2986/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2986/89 Being a by-law to assume Hampton Court, Plan M-1185, Pickering, for public use as a public highway under the jurisdiction of the Town. WHEREAS, Hampton Court is a highway shown on plan of subdivision and is therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public high- way; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over that highway (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add that highway to the regional road system); and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of that highway is therefore vested in The Corporation of the Town of Pickering; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The following highway is hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Picker- ing: Hampton Court according to Plan M-1185, Town of Pickering, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursu- ant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highway referred to in section 1. BY-LAW read a first, second and third time and finally passed this 16th day of January, 1989. The followiug highway is boreby assumed for public use as public highways under the jurisdiction of tine Council of The Gorporation of the Town of Picker- lng: Ilampton Court according to Plan M-1l$5, Town of Pickerin,~l, Regional Municipality of Dm'barn. 2. The Town Solicitor is hereby authorized to apply to the Land Rcgistrar pursu- ant to the I,and Titles Act, R.S.O. 1980, c.230, s.151, to have the Cra'potation entered as the owner nf l]le highway referrecl to in section 1. The following highway is hereby assumed for public use as public highways under the jurisdiction of ti~e Council of The Corporation of the Town of Picker- ing: Ilampton Court according to Plan M-1185, Town of Picketing, Regional Municipality of Durham. The following highway is hereby assumed for public use as public highways under the jurisdiction of the CounciI of The Corporation of the Town of Picker- in g: Hampton Court according to Plan M-1185, Town of Pickering, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursu- ant to the Land Titles Act, R.S.O. 1980, c.230, s.15l, to have the Corporation entered as the owner of the highway referred to in section 1.
