The following persons addressed Council with respect to traffic concerns on Walnut Lane: a) Erika Kalishman, 1821 Walnut Lane, stated her concern with respect to the speed at which vehicles travel along Walnut Lane. She advised that a traffic study was undertaken the week of October 6 and it was determined that 757 cars traveled at an average speed of 31 km. an hour along Walnut Lane. She stated that she disputes the validity of the results as it does not take into consideration the vehicles which are destined for the driveways immediately next to the recording device. She requested Council reduce the speed limit to 40 km an hour. - 1 - Council Meeting Minutes Monday, December 16,2002 7:30 p.m. b) Gayle Clow, 1811 Fairport Road, representing the Liverpool West Community Association, stated her support of Erika's comments and advised that the Liverpool West Community Association is in support of slowing the traffic and ensure the safety of pedestrians. She suggested an intensive awareness campaign, more traffic monitoring and lowering the speed limit. She questioned when the traffic study would be complete. 2. The following persons addressed Council with respect to the North Pickering Lands: a) Tommy Thompson, Whitevale, stated his disappointment that Council decided to go ahead with the Growth Management Study and his concern that this ad-hoc planning is helping the developers. b) Isabel Thompson, Whitevale, suggested that the Seaton planners come and show plans for innovative housing, something Pickering could be proud of and also for developers to come and meet with them. c) Sandy Ryder, Whitevale, stated that those living on the agricultural preserve want to ensure that they are well represented on the Steering Committee. d) Bruce Flaherty, Whitevale, supports a transparent planning process. He stated that to achieve this there are three necessary factors; a) full disclosure of which properties in the agricultural preserves are owned by developers; b) that someone living in the agricultural preserve and an active advocate of keeping the agricultural preserve sits on the Consultant Selection Committee; and c) further that someone living in the agricultural preserve and an active advocate of keeping the agricultural preserve sits on the Steering Committee. ill!) CARRIED Resolution #154/02 Moved by Councillor Ryan Seconded by Councillor Brenner That Council pass a Resolution authorizing: a) the acceptance of an Offer to Purchase those parts of Shirley Drive, Plan 473, designated as Parts 1,2 and 4, Plan 40R-21488 from Hollinger Construction Limited for the purchase price of $93,260.00, subject to a registered covenant restricting redevelopment of the property to a building height of 9 meters; and b) the execution of a Transfer of Easement in favour of the City over Parts 2 and 4, Plan 40R-21488 for stormwater management purposes. CARRIED Resolution #155/02 Moved by Councillor Pickles Seconded by Councillor Johnson WHEREAS in April 2001, the Federal Transport Minister announced that the Greater Toronto Airports Authority (GTAA) had been asked to determine the need for a future regional reliever airport on the Pickering lands; and WHEREAS a report prepared for the GT AA and released in September 2002 entitled "Pickering Lands Airport Planning Initiative - Financial Assessment Analysis" concluded that an airport based on a preliminary business model was feasible; and - 3- Council Meeting Minutes Monday, December 16,2002 7:30 p.m. WHEREAS this report is an important early component of the rationale for the potential establishment of an airport in Pickering and, therefore, the City of Pickering should review the Analysis and provide a response to the GT AA; and WHEREAS this report is a very technical document and provides a very specialized field of analysis that staff of the City of Pickering do not have the expertise to review and comment on in a meaningful way; and WHEREAS the City has received sufficient funding from proponents in special planning studies and reviews impacting the City of Pickering, including but not limited to, Special Study Areas, Ontario Power Generation's Return to Service of Pickering 'A', Ontario Power Generation's Waste Facility Expansion Study, and the Growth Management Study; NOW THEREFORE BE IT RESOLVED THAT the City of Pickering request that the Federal Transport Minister and the CEO of the Greater Toronto Airports Authority (GTAA) provide sufficient funding in order for the City of Pickering to acquire the appropriate qualified expert services to review the GT AA Financial Assessment Analysis and provide meaningful comments and recommendations to the Council and City of Pickering; and THAT the Mayor, on behalf of the City of Pickering, formally make this request in writing to the Transport Minister and the President and CEO of the GT AA, with a copy to the Member of Parliament for Ajax-Pickering-Uxbridge. CARRIED -4- ~'Ú¡ o~ . 181 I I Council Meeting Minutes Monday, December 16,2002 7:30 p.m. Recorded Vote: Yes: Councillors Brenner, Holland, Mclean, Ryan and Mayor Arthurs No: Councillors Johnson and Pickles Resolution #156/02 Moved by Councilor Mclean Seconded by Councilor Holland WHEREAS the Durham Regional Seniors Games Association has been in operation since 1982 and is represented by eight regional municipalities; and WHEREAS the Seniors Games are available to anyone over the age of 55 years of age who wish to compete in as many as twelve events that take place in the Region, drawing up to 1000 competitors from within the Region; and WHEREAS funding for these events is derived from event registration fees paid by the participants. Out of this registration an affiliation fee is paid to the Ontario Seniors Games Association who in turn host an ACTIFEST Olympics every second year in a host City; and WHEREAS The Ontario Games Association has raised their affiliation fees by 66%, putting a strain on participants and putting these Games at risk; and WHEREAS The Seniors Games are an important part of a healthy mental and physical lifestyle that offers social and competitive challenges; and WHEREAS this one-time funding grant would assist this organization in continuing the Games while they implement other fundraising activities and events. NOW THEREFORE the Corporation of the City of Pickering make a grant in the amount of $1500 to the Durham Regional Seniors Games in support of competitions in the Region for the year 2003 for persons over 55 years of age; and THAT this grant be charged to Account 2195 (Grants to Organizations & Individuals); and FURTHER THAT this resolution be circulated to the other municipalities within the Region of Durham to match this grant. CARRIED - 5- Council Meeting Minutes Monday, December 16, 2002 7:30 p.m. Recorded Vote: Yes: Councillors Brenner, Holland, Johnson, Mclean, Pickles, Ryan and Mayor Arthurs Resolution #157102 Moved by Councillor Mclean Seconded by Councillor Holland WHEREAS the City of Pickering has undertaken a pilot project for the curbside collection of organics and expanded recyclables which has achieved a diversion rate of over 60% in the test community of Amberlea while achieving widespread public acceptance and approval; and WHEREAS the City of Pickering embarked upon the above noted pilot project to prove that achieving greater than 50% diversion in Durham is possible today; and WHEREAS the residents of the City of Pickering and the Council of the Corporation of the City of Pickering have long stated that they are ready for a curbside composting program and expanded recyclables across the City to deliver a diversion rate in excess of 50%; and WHEREAS the Region of Durham stands to financially benefit from the diversion of waste from landfill as it will not have to pay to dispose of that waste; and WHEREAS the City of Pickering does not have the financial capacity to implement an organic curbside collection service or jurisdictional authority to expand the current list of recyclable materials; and WHEREAS the Government of Ontario has created significant incentives to municipalities that achieve waste diversion rates greater than 50% but many of those incentives are time sensitive; and WHEREAS residents expect the Region of Durham to act expediently on the issue of waste diversion and implement proven technologies for the benefit of the environment and future generations; and WHEREAS the Region of Durham has debated and considered the issue of increased recyclables and curbside collection of organics since 1994 and has yet to commit to a program; and -6- Council Meeting Minutes Monday, December 16,2002 7:30 p.m. WHEREAS the Region of Durham will be reviewing its waste management practices at the end of February or the beginning of March of 2003 through the 'Solid Waste Financing and Servicing Study' (SWFSS); NOW THEREFORE the Council of the Corporation of the City of Pickering hereby requests the Region of Durham to commit to a curbside organic waste collection system and expanded recyclables (similar to the cart bin system that is currently provided to the residents of Amberlea in the City of Pickering's waste diversion pilot project) across the entire Region prior to April 30, 2003 for implementation no later than the end of June 2003 for the expanded recyclables and November 30, 2003 for organics; and FURTHER THAT this resolution be circulated to the other municipalities within the Region of Durham for endorsement with relevant data and information from their municipalities; and FURTHER THAT this motion be circulated to: Roger Anderson, Regional Chair Jack McCorkell, Commissioner of Regional Works Janet Ecker, M.P.P. CARRIED -8- Council Meeting Minutes Monday, December 16,2002 7:30 p.m. THIRD READING: Councillor Ryan, seconded by Councillor Brenner, moved that the report of the Committee of the Whole on By-law Numbers 6070/02,6071/02,6072/02,6073/02,6074/02,6075/02, 6076/02 and 6077/02, be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED v OTHER BUSINESS 1. Mayor Arthurs, on behalf of all Council Members and their families, extended a Merry Christmas to all Pickering constituents. 2. Councillor McLean congratulated staff of the King Richards Pub for their work in raising $10,000 for the Children's Wish Foundation. 3. Councillor Ryan thanked Andrew Chung and Pickering Toyota for the Children's Christmas Party held on Saturday. 4. Councinor Ryan urged residents to donate to the St. Paul's on the Hill Food Bank. 5. The following matters were discussed prior to the regular meeting: a) The Chief Administrative Officer distributed copies of correspondence from the Pickering Squash Club concerning partnering with the City. b) The Director, Planning & Development commented on a matter concerning the Committee of Adjustment and requested direction on how to handle Council's concerns. c) Mayor Arthurs distributed a copy of a fax received late today from The Honourable Chris Hodgson concerning the North Pickering Lands. - 9- . PLANNING & DEVELOPMENT REPORT PO 55-02 PROPOSED AMENDMENTS TO THE DURHAM REGION OFFICIAL PLAN TO ESTABLISH CONFORMITY WITH THE OAK RIDGES MORAINE CONSERVATION PLAN (ORMCP) 1. That Council RECEIVE for information Report Number PO 55-02, respecting proposed amendments to the Durham Region Official Plan to implement the Oak Ridges Moraine Conservation Plan (ORMCP); 2. That Council ENDORSE Report Number PO 55-02, supporting, in principle, the proposed amendments to the Durham Region Official Plan to implement the ORMCP, provided the Proposed Amendments are revised to: . recognize existing uses; . reconcile inconsistencies regarding existing uses; . allow lower-tier municipalities to refine all land use designations, consistent with the ORMCP; . allow "Low-Intensity Recreational Uses" without requiring a Regional Official Plan Amendment; . identify prime agricultural lands; . provide further information and clarification regarding data management and monitoring of the Oak Ridges Moraine and ORMCP; and . recognize Altana as a Hamlet / Rural Settlement; 3. That Council REQUEST that the Minister of Municipal Affairs and Housing amend the Oak Ridges Moraine Conservation Plan to: (i) allow lower-tier municipal Official Plans and/or Zoning By-laws to recognize existing uses that have received Planning Act approvals prior to November 15, 2001; and (ii) recognize Altona as a "Rural Settlement" on the "Oak Ridges Moraine Conservation Plan Land Use Designation Map", numbered 208, dated April 17,2002; 4. That Council RECOMMEND that the Region of Durham request that the Minister of Municipal Affairs and Housing amend the Oak Ridges Moraine Conservation Plan as outlined in Recommendation #3 to Report PO 55-02; - 11 - Appendix I Planning Committee Report PC 2002-10 5. That Council REQUEST that the Region of Durham provide lower-tier municipalities an opportunity to comment on any future revisions to the proposed amendments to the Durham Region Official Plan to implement the Oak Ridges Moraine Conservation Plan (ORMCP) prior to adoption by Regional Council; and 6. That the City Clerk FORWARD a copy of Report Number PO 55-02 to: Minister of Municipal Affairs & Housing; Clerk, Region of Durham; and Clerks of lower-tier Municipalities in Durham Region. - 12 - Appendix II Committee of the Whole Report COW 2002-12 That the Committee of the Whole of the City of Pickering having met on December 9, 2002, presents its twelfth report to Council and recommends: 1. OPERATIONS & EMERGENCY SERVICES REPORT OES 52-02 RECREATION, PARKS AND CULTURAL SERVICES MASTER PLAN FINAL REPORT 1. That Report OES 52-02 be received by Council; and 2. That the Recreation, Parks and Cultural Services Master Plan Final Report (November 2002) be endorsed as a planning document; and 3. That the appropriate officials of the City of Pickering be given authority to give effect thereto. 2. CHIEF ADMINISTRATIVE OFFICE REPORT CAO 08-02 KINGSTON ROAD DESIGN OPPORTUNITIES STUDY CITY OF PICKERING COMMENTS 1. That Council receive for information Report CAO-08-02 concerning the Kingston Road Design Opportunities Study, prepared by Totten Sims Hubicki Associates (TSH) for the Region of Durham; and 2. That Council endorse the following recommendations: i) That a signalized intersection and formalized pedestrian crossing be established on Kingston Road mid-block between Liverpool Road and Glenanna Road; and ii) That the Region of Durham continue to offer excess road allowance along Kingston Road to abutting private landowners to encourage development opportunities and enhanced landscaped areas on properties fronting Kingston Road; and iii) That the Region of Durham commence the detailed design work of Kingston Road between Pine Creek and the Ontario Hydro Corridor (east of Valley Farm Road) in 2003, and commence the implementation of works in 2004; and 3. That Council authorize the CAO to prepare in 2003 a liS-Year Downtown Implementation Strategy" for Council's consideration. - 13- Appendix II Committee of the Whole Report COW 2002-12 4. That a copy of this Report and Council's recommendations be circulated to the Region of Durham. 3. CHIEF ADMINISTRATIVE OFFICE REPORT CAO 09-02 DRAFT ENVIRONMENTAL ASSESSMENT GUIDELINES PICKERING (NUCLEAR) WASTE MANAGEMENT FACILITY EXPANSION 1. That Report CAO 09-02 regarding the Pickering (Nuclear) Waste Management Facility Expansion be received; and 2. That Council endorse Report CAO 09-02, including the comments provided by Acres & Associated, as the City of Pickering's comments on the draft EA guidelines for the Pickering (Nuclear) Waste Management Facility Expansion; and 3. That Report CAO 09-02 be forwarded to the Canadian Nuclear Safety Commission for consideration in finalizing the EA guidelines for the Pickering (Nuclear) Waste Management Facility Expansion, to the Ontario Power Generation, and to the Nuclear Waste Management Association for information. 4. CLERKS REPORT CL 40-02 PROPOSED REGIONAL SMOKING BY-LAW That the Council of the City of Pickering hereby advises the Council of the Regional Municipality of Durham that it supports the Regional Smoking By-law, attached as Appendix "0" to Report #2002-MOH-40 of the Commissioner & Medical Officer of Health; and FURTHER that the Council of the City of Pickering states it's objection to any material alteration of the by-law that would lead to weakening any of its provisions; and FURTHER that this motion be circulated to all lower tier municipalities in Durham, to the Regional Chair, the Commissioner and Medical Officer of Health and the Chair of Health and Social Services. - 14-
