HomeMy WebLinkAboutBy-law 3593/90 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3593/90 Being a by-law m stop up and close part of the road allowance between Ranges 2 & 3, Broken Front Concession, Pickering, as public highway and to authorize the sale thereof to the abutting owner (Part 1, Plan 40R-12891; part of Montgomery Park Road). WHEREAS The Corporation of the Town of Pickering is the owner of a section of public highway known as Montgomery Park Road being that part of the road allowance between Ranges 2 and 3, Broken From Concession, Pickering, designated as Part 1, Plan 40R-12891; and WHEREAS, pursuant to the provisions of the MunicipalAct, R.S.O. 1980, chapter 302, sections 193(1), 298(1)(c), 298(1)(d) and 316, the Council of any municipality may pass by-laws to stop up a highway or part thereof and to authorize its sale or the sale of a part thereof at a fixed price; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. That part of Momgomery Park Road, being that part of the road allowance between Ranges 2 and 3, Broken From Concession, Picketing, designated as Part 1, Plan 40R-12891, is hereby stopped up and closed to vehicular and pedestrian traffic. 2. The lands described in section 1 shall be offered for sale to the abutting owner for the sale price of $2.00. 3. The offer referred to in section 2 shah be made by the Town on or before December 31, 1990. 4. The period within which the abutting owner may exercise his right to purchase the lands described in section I shall commence at 9:00 a.m. on January 2, 1991, and end at 4:00 p.m. on January 31, 1991. 5. The Mayor and Clerk are hereby authorized to execute all necessary documents to effect the road closing referred to in section 1, the offer to sell referred to in section 2, and any consequent transfer of the lands described in section 1 to the abutting owner. BY-LAW read a first and second time this 19th day of November, 1990. BY-LAW read a third time and finally passed this 17th day of December, 1990.
