HomeMy WebLinkAboutBy-law 3589/90 THE CORPORATION OF THE TOWN OF P1CKERING BY-LAW NUMBER 3589/90 Being a Zoning By-law to amend Zoning By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lot 17, Range 3, Broken Front Concession, Town of Picketing. (A 17/89) WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to add as a permitted use in Part of Lot 17, Range 3, Broken Front Concession, restaurants, type A, so long as the maximum gross leasable area of all such restaurants do not exceed 407 square metres; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: A. TEXT AMENDMENT 1. Section 2 of By-law 2511, as amended, is hereby further amended by revoking subsection 2.38.2 in its entirety and substituting therefor the following definition: 2.38.2 GROSS LEASABLE AREA "Gross Leasable Area" shall mean the total gross floor area designed for tenant occupancy and exclusive use, including basements, mezzanines and upper floors if any, measured from the centre hne of joint partitions and from outside wall faces. 2. Section 2 of By-law 2511, as amended, is hereby further amended by adding as subsection 2.63.1 the following definition: 2.63.1 RESTAURANT, TYPE A "Restaurant, Type A" shall mean a building or part of a building where food is prepared and offered for retail sale to the public for immediate consumption on the premises or off the premises, or both on and off the premises. 3. Section 18 of By-law 2511, as amended, is hereby further amended by adding thereto the following subsection: 18.3.4 Despite the provisions of subsection 18.1 of this section and in addition to all other uses permitted under that subsection, restaurants, type A, may be permitted at the southwest corner of Squires Beach Road and Clements Road, on the lands designated "(H)M2S" on Schedule I to By-law 3580/9o, providing the aggregate of the gross leasable areas of all such restaurants does not exceed 407 square metres. B. SCHEDULE I Schedule I to this By-law is hereby declared to be part of this By-law and the provisions of this By-law shall apply to the lands designated "(H)M2S" on Schedule I attached hereto. C. BY-LAW 2511 By-law 2511, as amended, is hereby further amended only. to the extent necessary to give effect to the provisions of this By-law. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 2511, as amended. -2- D. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
