HomeMy WebLinkAboutBy-law 3586/90 T N F TH~WN~FPJ_CK!E~G BY-LAW NO. 358~t90 Being a by-law W authorize the execution of a transfer of a closed portion of Brock Road to the abutting owner ( Ontario Hydro ). WHEREAS, pursuant to the provisions of, (a) an Agreement dated April 26, 1974, between Ontario Hydro and The Corporation of the Town of Pickering, and (b) section 443 of The Municipal Act, R.S.O. 1970, chapter 284, on September 16, 1974, the Council of The Corporation of the Town of Pickering enacted By-law 110/74, stopping up and closing as public highway a part of the road known as Brock Road, being that part of the Road Allowance between Lots 18 and 19, Range 2, Broken Front Concession, Pickering, more particularly described in Schedule A thereto, which By-law was registered December 19, 1974 as Instrument No. D190; and WHEREAS Ontario Hydro is the abutting owner of the lands closed by By-law 110/'/4 and has, (c) agreed to convey to the Town that part of Lot 17, Broken Front Concession, Pickering, designated as Parts I and 2, Plan 40R-12330; and (d) arranged with Her Majesty the Queen in right of Ontario as represented by the Mioister of the Environment for the conveyance to the Town of that part of Lot 17, Broken Front Concession, Picketing, designated as Part 3, Plan 40R-12330, for the purpose of providing an alternate roadway to that closed by By-law 110/74; and WHEREAS, pursuant to the provisions of section 317 of the Municipal Act, R.S.O. 1980, chapter 302, Ontario Hydro is therefore entitled to the soft and freehold of the road closed by By-law 110/74 and to a conveyance of it; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby anthorized to execute a transfer, in the form attached hereto as Schedule A, of that part of Brock Road closed by By-law 110/74, being that part of the Road Allowance between Lots 18 and 19, Range 2, Broken Front Concession, Pickering, more particularly described in Instrument DI90, from The Corporation of the Town of Pickering to Ontario Hydro for no consideration. BY-LAW read a first, second and third time and f'mally passed this 5th day of November, 1990.
