BY-LAW NO. ~saa/90
Being a by-law to establish Lot 60, Plan M-90, Pickeringo as
public highway (Simpson Avenue).
WHEREAS Lot 60, Plan M-90, Pickering (also known as "Simpson Avenue") is a road on
which public money has been expended and is therefore a common and public highway
pursuant to section 257 of the Municipal Act, R.S.O. 1980, chapter 302 (the "Act"); and
WHEREAS, since jurisdiction over Simpson Avenue has not been expressly conferred up. on
another council and Simpson Avenue is a highway within the Town of Plckering, the Council of
The Corporation of the Town of Picketing has jurisdiction over Simpson Avenue, pursuant to
section 259 of the Act; and
WHEREAS the soil and freehold of Simpson Avenue is therefore vested in The Corporation of
the Town of Pickering, pursuant to section 258 of the Act; and
WHEREAS The Corpor.ation of the Town of Pickering wishes to confirm the.establishment of
Simpson Avenue as public highway under its jurisdiction, pursuant to subsection 298(1) of the
Act;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOIJOWS:
1. Lot 60, Plan M-90, Pickering, is hereby established as public highway under the
jurisdiction of The Corporation of the Town of Pickering. (Simpson Avenue).
2. This by-law shall not come into effect until it is approved by the Minister of Municipal
Affairs pursuant to subsection 306(2) of the Municipal Act, R.S.O. 1980, chapter 302.
BY-LAW read a first, second and third time and finally passed this 17th day of September,
1990.
