Limited to The Corporatton of the Town of Picketing in Plans 40M-1629 and 40M-1630, Picketing. WHEREAS The Corporation of the Town of Pickering requires storm sewer easements for the purpose of draining, storm water through Plans 40M-1629 and 40M-1630, Picketing, and pursu .a~.t to the provtsio .ns of section 193 of the Municipal Act, R.S.O. 1980, chapter 302, the Council of The Corporation of the Town of Picketing may pass by-laws for acquiring interests in lands; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, in the form attached hereto as Schedule A, from Nugget Construction Co. Limited to The Corporation of the Town of Picketing over those parts of Lots 4, 5, 7, 8, 61 and 62, Plan 40M-1629, Picketing, designated as Parts 1 to 6, Plan 40R-12960. 2. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, in the form attached hereto as Schedule B, from Nugget Construction Co. Limited to The Corporation of the Town of Pickering over those parts of Lots 7, 8, 13, 14, 55, 56, 70, 71, 79, 80, 102, 103, 108, 109, 111, 112, 116, 117, 134, 135, 137, 138, 142, 143, 146, 147, 162, 163, 164, 165 and 166, Plan 40M-1630, Picketing, designated as Parts 1 to 32, Plan 40R-12961. The Transient hereby releases the Transferee from any cla~ which may arise out of the exercise by the Tr~sferee of the ~ht ~fld easement ~ranted here- by, or which may a~se out of the existence or operation of the store dr~nage works, provided the Tr~sferee fills ~ all excavations and as far as Is practi- cable restores the surface to the condition existing p~or to ~ny ent~ ther~n to exercise the ~ght hereby granted. 4. The Transferor covenants that it shall execute such further assurances of the ~ght and easement granted hereby as may be required by the Transferee. 5. The burden of this Transfer and of all the covenants contained herein shall run ~th the lands herein desc~bed, This Transfer shall be binding upon and sh~l enure to the benefit of the parties hereto and their respec6ve successors and assisns. LAND BENEFITED (DOMINANT TENEMENT) 7. The benefit of this Transfer and all of the covenants contained herein shall run with all other lands and interests in land owned, occupied e~ used by the Transferee, its auccessors and asaigns for the purpose of operating and main- taining storm drainal~e works.
