HomeMy WebLinkAboutBy-law 3517/90 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3517 /90 Being a by-law to authorize the execution of a Release and Discharge of Instrument Number LT180753 respecting Plans M-1210 and 40M-1267, Pickering. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c. 1, s.50, or a pred. ecessor thereof, The Corporation of the Town of Picketing and Hel.d.or Development Corporatton entered into an Agreement dated June 16, 1980, Notice of which was registered on August 3, 1983 as Instrument No. LT180753, respecting the subdivision and development of Plans M-1210 and 40M-1267, Pickering; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated June 16, 1980, Notice of which was registered August 3, 1983 as Instrument No. LT180753, between Heldor Development Corporation and The Corporation of the Town of Picketing, respecting the subdivision and development of Plans M-1210 and 40M-1267, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this/Sfh day of August, 1990. Bruce Taylor, Clerk TOWN I~ICKER!NG RELEASE p~D DISCILARGE WHEREAS the .Agreement dated June 16, 1980, .N.o. tice of which was registered August 3, 1983, in the Land Registry Office for the Land Titles Dlwsion of Durham (No. 40) as Instrument No. LT180753, between, HELDOR DEVELOPMENT CORPORATION hereinafter referred to as the "Company" THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 36, inclusive, Blocks 37 to 46, inclusive, Bridle Path Circle, Linwood Street, Parkdale Street and Redwood Lane in Plan M-1210, and Lots 1 to 41, inclusive, Blocks 42 to 57, inclusive, Bridal Path Circle, Grovedale Court, Linwood Street and Parkdale Street in Plan 40M-1267 in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 8th day of August, 1990.
