HomeMy WebLinkAboutBy-law 3515/90 THE CORPORATION OF THE TOWN OF PICKERING ]BY-LAW NO, 3515/90 Being a by-law to assume d. spen Road and Pebble Court, Plan 40M-1323, Picketing, for public use as public highways under the jurisdiction of the Town. WHEREAS, Aspen Road and Pebble Court are highways shown on plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public highways; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, $.259, the Council of The Corporation of the Town of Pickering has jurisdiction over those highways (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality.of Durham Act, R.S.O. 1980, c.434, s.28, to add those highways to the regional road system), and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of those highways is therefore vested in The Corporation of the Town of Pickering; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The following highways are hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Pickering: Aspen Road and Pebble Court both according to Plan 40M-1323, Town of Pickering, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to l~ave the Corporation entered as the owner of the highways referred to in section 1.
