WltEREAS pursuant to the Municipal Act, R.S.O. 1980, chapter 302, section 208.1, all municipalities may enter into Agreements with other municipalities for the use of the fire fighting equipment or any of it thereof; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute an Agreement in the form attached hereto as Schedule A, between The Corporation o{ the Town of Picketing and The Corporation of the Township of Uxbrldge for the provision of emergency assistance to the Township of Uxbridge, from and after January 1, 1990. BY-LAW read a first, second and third time and finally passed this 18th day of December, 1989. DETWEENt THE CORPORATION OF THE TOWN OF PICKERING - and - THE CORPORATION OF THE TOWNSHIP OF UXBRIDGE WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, section 208.1, ali municipalities may enter into agreement with other municipalities for the use of the fire-fighting equipment, or any of it, thereof; NOW TItEREFORE THIS AGREEMENT witneaaeth that, in consideration of the terms, covenants and conditions herein, and other valuable consideration, the parties agree as follows ~ 1. In this Agreement, the term, (a) 'emergency~ means a situation requiring equipment; (h) *equipments includes trucks, vehicles and other equipment used for the suppression of fires, the rescue of persons or the protection of property, and includes the persons necessary to operate such equipmentl (c) afire chiefs means the person or persons from time to time appointed by the Council of Picketing or Uxbridge as its Fire Chief, and includes the person or persons so appointed as Deputy Fire Chief, and all designates of them~ (dj SPickeringS means The Corporation of the Town of Plckertng~ (e) ~Uxbridgen means The Corporation of the Township of Uxbridge, and the geographic territory over which it has jurisdiction. Subject to the provisions of Section $, Picketing shall respond to calls for assistance in an emergency located within Uxbridge when requested to do so by the fire chief of Uxbridge~ 3. (1) The fire chief of Picketing shall have the sole discretion to determine, (a) whether or not to respond to Uxbridge's call for assistance, (b) the amount and type of equipment Pickerlng will provide, if any~ and (c) the length of time for which such equipment will be provided. 4, (1) The most senior officer present from Uxbridge shall be in command of all equipment at the emergehcy. (2) Where no equipment is present from Uxbridge, the most senior officer present from Pickering shall be in command until personally relieved by the most senior officer arriving from Uxbridge. 5. The' fee payable by Uxbridge to Picketing for assistance provided hereunder shall be calculated as follows: (a) $750 for each rescue equipment response (one pumper with up to four persons and one rescue vehicle with two persons)~ (b) $750 for each fire-fighting equipment response (one pumper with up to four persons and one tanker with up to two persons)~ (c) $1000 for each combined rescue and fire-fighting equipment response (one pumper with up to four persons, one rescue vehicle with two persons and one tanker with up to two persons)~ (d) $750 for each additional vehicle (except fire chief c~'s) and crew supplied · in any response, and shall be paid by Uxbridge within 30 days of the date of Pickeringts invoice the~efor. 6,. (1) Uxbridse hereby releases and forever discharges Picketing of and from all manner of action, causes of action~ suits, debts, damages, costs,., expenses, claims, or demands which against Picketing it hsd, has or may have, or its successors and assigns, or any of them, can, shall or may have arising out of the execution of this Agreement, or of any assistance provided or not provided hereunder, (2) In accordance with the provisions of the Act referred to above, no liabil- ity .shall accrue to Pickering or any person for f~llinS to supply equip- meat, or any of it, 7. Either party may terminate this Agreement upon thirty days written notice delivered or sent by registered mail to the fire chief and municipal clerk of the other. IN WITNESS WHEREOF the parties hereunto have affixed their corporate seals duly attested to by their proper signing officers in that behalf.
