HomeMy WebLinkAboutBy-law 3324/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3324/89 Being a By-law to amend Restricted Area (Zoning) By=law 2015/85, which amended Restricted Area (Zoning) By-law 3036~ as amended~ to implement the Official Plan of the Town of Picketing District Planning Area~ Region of Durham~ in Part of Block 69 and Part of Block 70~ Plan #0M-1511~ in the Town of Pickering. (A 7/89; 1gT-89023) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 2015/85, amending By-law 3036 to permit the development of detached dwellings to occur on the subject lands being Part of Block 69 and Part of Block 70, Plan #0M-1511, in the Town of Picketing; AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it desirable to further amend By-law 3036 as amended by By-law 2015/85 to permit the creation of a lot supporting an existing dwelling which provides a rear yard depth of 3.0 metres and which has a detached garage in the front yard; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENTS fl) Section 2 of By-law 2015/~5 is hereby amended by adding the zone designation "SI-6" after (2) Section 5 of By-law 2015/85 is hereby amended by adding thereto the following subsection: (2) fa) Use Permitted ("SI-6" Zone) No person shall within the lands designated "SI-6" on Schedule "I" attached hereto use any lot or erect~ alter or use any building or structure for any purpose except the following: fi) detached dwelling residential use (b) Zone Requirements ("SI-6" Zone) No person shall within the lands designated "SI-6' on Schedule "I" attached hereto~ use any lot or erect~ alter or use any building except in accordance with the following provisions: fi) LOT AREA (minimum): qS0 square metres (ii) LOT FRONTAGE (minimum): 15.0 metres (iii) FRONT YARD DEPTH (minimum): #.5 metres (iv) INTERIOR SIDE YARD WIDTH (minimum): A minimum 1.2 metres each side, or B minimum 1.8 metres one side and no minimum other side -- 2 = (v) REAR YARD DEPTH (minimum): A where a dwelling or any part or extension is constructed before January 1, 1990 3.0 metres B where a dwelling or any part or extension is constructed after December 31, 1989 7.3 metres (vi) LOT COVERAGE (maximum): 38 percent (vii) BUILDING HEIGHT (maximum): 12 metres (viii) DWELLING UNIT REQUIREMENTS: maximum one dwelling unit per lot and minimum dwelling unit area of 100 square metres (ix) PARKING REQUIREMENTS: minimum one private garage per lot attached to or detached from the main building, any vehicular entrance of which shall be located not less than 6.0 metres from the front lot line and not less than 6.0 metres from any side lot line immediately adjoining or abutting on a reserve on the opposite side of which is a street (x) SPECIAL REGULATIONS: the horizontal distance between buildings on adjacent lots to which this section applies shall not be less than 1.8 metres (3) Section 3 of By-law 2013/85 is hereby further amended by changing subsection (2) to subsection (3), subsection (3) to subsection (#), subsection (t/) to subsection (3), and subsection (3) to subsection (6). 2. SCHEDULE AMENDMENT (1) Schedule "1" to By-law 2015/83 is hereby amended by changing from "SI" to "SI-6" the zone designation of the lands hatched on Schedule "I" attached hereto. 3. BY-LAW 2015/85 By=law 2015/85) as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By=law as it applies to the lands hatched on Schedule "l" attached hereto. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 2015/85. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subiect to the approval of the Ontario Municipal Board, if required.
