HomeMy WebLinkAboutBy-law 3298/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3298/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-1197, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Picketing and Willowridge Construction Limited entered into an Agreement dated March 17, 1980, Notice of which was regis- tered on August 28, 1980 as Instrument No. LTl12264, respecting the subdivision and development of Plan M-1197, Pickerlng; WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated March 17, 1980, Notice of which was registered August 28, 1980 as Instrument No. LTl12264, between Willowridge Construction Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1197, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 6th day of No- vember, 1989. RELEASE AND DISCHARGE WHEREAS the Agreement dated March 17, 1980, Notice of which was registered August 28, 1980 in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LTl12264, between, WILLOWRIDGE CONSTRUCTION LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes o£ action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 7 inclusive, Blocks 8 and 9 and Willowside Court in Plan M-1197, Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 6th day of November, 1989.
