HomeMy WebLinkAboutBy-law 3271/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO.3271 /89 Being a by-law to assume Ada Court, Shadybrook Drive and Jacqueline Avenue (being Parts 1 and 2 on Plan 40R-2335), Plan M-1060, Picketing, for public use as public highways under the jurisdiction of the Town. WHEREAS, Ada Court, Shadybrook Drive and Jacqueline Avenue (being Parts 1 and 2 on Plan 40R-2335) are highways shown on plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.67, to be public high- ways; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over those highways (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add those highways to the regional road system); and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of those high- ways is therefore vested in The Corporation of the Town of Picketing; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The following highways are hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Picker- ing: Ada Court, Shadybrook Drive and Jacqueline Avenue (being Parts 1 and 2 on Plan 40R-2335) all according to Plan M-1060, Town of Pickering, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursu- ant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highways referred to in section 1.
