HomeMy WebLinkAboutBy-law 3240/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO.3240 /89 Being a by-law to assume services under the jurisdiction of the Town in Plan 40M-1326, Picker- lng. WHEREAS, pursuant to, where applicable, the Municipal Act, R.S.O. 1980, c.302, ss.259, 284, 286, 298 and 315.7; the Planning Act, 1983, s.o. 1983, c.1, s.50; the Regional Municipality of Durham Act, R.S.O. 1980, c.434, ss.34 and 53, and the Agreement dated June 18, 1984 (Notice of which was registered on October 4, 1984 as Instrument No. LT216611), between Kenneth Hollinger and The Corporation of the Town of Pickering, aboveground and underground services under the jurisdiction of the Town in Plan 40M-1326, Pickering, have been completed to its satisfaction; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The aboveground services under the jurisdiction of the Town, that are required to be constructed or installed in the development of Plan 40M-1326, Picketing, including the roads, curbs and gutters, sidewalks, driveway aprons, boule- vards, street signs, fencing and grading, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan 40M-1326, Picketing, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of May 10, 1989. 2. The underground services under the jurisdiction of the Town that are required to be constructed or installed in the development of Plan 40M-1326, Picketing, including the storm drainage system and related appurtenances, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan 40M-1326, Picketing, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of May 10, 1989. 3. In sections 1 and 2, the phrase "lands that are ... owned by the Town" in- cludes lands that are subject to an easement transferred to the Town, but only with respect to the specific service or services referred to in the easement transfer document.
