HomeMy WebLinkAboutBy-law 3190/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3190/89 Being a by-law to assume Maple Gate Road, Meadowlane Crescent, Wildrose Crescent, Timber Court and Cedarwood Court, Plan M-1222, Picketing, for public use as public highways under the jurisdiction of the Town. WHEREAS, Maple Gate Road, Meadowlane Crescent, Wildrose Crescent, Timber Court and Cedarwood Court are highways shown on plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public high- ways; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over those highways (the Council of The Regional Municipality of Burham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add those highways to the regional road system); and WHEREAS pursuant to the Municipal Act, s,258, the soil and freehold of those high- ways is therefore vested in The Corporation of the Town of Pickering; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The following highways are hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Picker- ing: Maple Gate Road, Meadowlane Crescent, Wildrose Crescent, Timber Court and Cedarwood Court all according to Plan M-1222, Town of Pickering, Regional Municipality of Durham. 2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursu- ant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highways referred to in section 1.
