HomeMy WebLinkAboutBy-law 3187/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3187/89 Being a by-law to authorize the execution of a Release and Discharge of the Development Agree- ment respecting those parts of Lot 34, Plan 228, Pickering, designated as Parts 2, ~ and 4, Plan 40R-10032. WHEREAS pursuant to the Planning Act, 1983, S.O. 1983, chapter 1, section 50 and as a condition of the approval of rezoning application A 22/86, James Nicol Brown and Helen Brown entered into a Development Agreement with The Corporation of the Town of Picketing which Agreement is dated March 18, 1987 and was registered on title on May 28, 1987 as Instrument D249821, respecting the development of those parts of Lot 34, Plan 228, Picketing, designated as Parts 1, 2, 3 and 4, Plan 40~R-10032~ and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to Parts 2, 3 and 4, Plan 40R-10032; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge in the form attached hereto as Schedule A of the Development Agreement dated March 18, 1987, a copy of which was registered May 28, 1987 as Instrument No. D2q9821 between James Nicol Brown, Helen Brown and The Corporation of the Town of Picketing, insofar as that Agreement affects those parts of Lot 34, Plan 228, Picketing, designated as Parts 2, 3 and 4, Plan 40R-10032. 2. Schedule A hereto forms part of this by-law. BY-LAW read a first, second and third time and finally passed this 19th day of June, 1989. RELEASE AND DISCHARGE WHEREAS, by Agreement dated March 18, 1987, a copy of which was registered on May 28, 1987, in the Land Registry Office for the Registry Division of Durham as Instrument No. D249521 between, JAMES NICOL BROWN and HELEN BROWN hereinafter collectively referred to as the '~Owner" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town'~ # provided tot the development of those parts of Lot 34, Plan 228, Ptckering, designated as Parts 1, 2, 3 and 4, Plan 40R-10032; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to part of those lands, namely Parts 2, 3 and 4, Plan 40R-10032; THE TOWN HEREBY remises, releases and forever discharges the persons comprising the Owner, their respective heirs, executors, administrators, successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which they, or either of them, may have been, are, or may become subject to pursuant to the provisions of the Agreement, as it affects Parts 2, 3 and 4, Plan 40R-10032. THIS RELEASE AND DISCHARGE affects the lands described as: Those parts of Lot 34, Plan 228, designated as Parts 2, 3 and 4, Plan 40R-10032, in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal attested by its properly authorized officers. Dated at Picketing this 19th day of June, 1989.
