HomeMy WebLinkAboutBy-law 3047/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO.3047 /89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-1057, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Township of Picketing and Bramalea Consolidated Developments Limited entered into an Agreement dated December 17, 1973, Notice of which was registered on March 5, 1976 as Instrument No. LTD16542 respecting the subdivision and development of Plan M-1057, Picketing; WHEREAS The Corporation of the Town of Picketing is the successor to The Corpo- ration of the Township of Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated December 17, 1973, Notice of which was registered March 5, 1976, as Instrument No. LTD16542 between Bramalea Consolidated Developments Limited and The Corporation of the Township of Pickering, respecting the subdivision and development of Plan M-1057, Pickering. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 20th day of February, 1989. Wayne A.~'h~rs, Mayor -TOWN OF A?i:'i~OVED LEGAL DEP RELEASE AND DISCHARGE WHEREAS the Agreement dated December 17, 1973, Notice of which was registered March 5, 1976 in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LTD16542 between, BRAMALEA CONSOLIDATED DEVELOPMENTS LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF TIlE TOWNSHIP OF PICKERING [of which The Corporation of the Town of Pickering is the successor] hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 232 inclusive, Blocks B to G inclusive, Blocks K, M, N and O and Shadybrook Drive, Briar Wood Gate, Eastbank Road, Meadowview Avenue, Edgewood Road, Cobbler's Court and Kate's Lane on Plan M-1057; Lots 233 to 352 inclusive, Blocks Q, S, U, W, X, Y, R-l, S-l, T-l, U-l, V-l, W-I and millbank Road, Parkside Drive, New Street, Una Road, Cricket Lane, Strouds Lane, Shadybrook Drive and Hedgerow Place on Plan M-1058; Lots 353 to 403 inclusive, Lots 406 to 446 inclusive, Blocks B-l, C-l, D-l, F-l, G-l, I-l, J-l, K-i, L-l, M-l, N-i, O-1, P-1 and Parkside Drive, Aspen Road and Pebble Court on Plan M-1059; Lots 1-19 inclusive, Blocks 20-25 inclusive, Blocks 27-33 inclusive and Aspen Road and Stonepath Circle on Plan M-1219; Lots 1-23 inclusive, Block A and Minstrel Manor on Plan M-1165; and Blocks 1-8 inclusive and Orion Court and Belinda Court on Plan M-1227; all in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. Dated at Picketing, Ontario this 20th day of February, 1989.
