HomeMy WebLinkAboutBy-law 2988/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2988/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment and amendment thereto respecting Plan M-1185, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Pickering and Eaglebrook Investments Limited and Ballycroy Investments Limited entered into an Agreement dated June 5, 1978, Notice of which was registered on March 7, 1980 as Instrument No. LT105123, respecting the subdivision and development of Plan M-1185, Pickering, which Agreement was subsequently amended by Agreement dated December 15, 1980, Notice of which was registered on March 31, 1981 as Instrument No. LT121877; and WHEREAS the terms and conditions of that Agreement, as amended, have been com- plied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated June 5, 1978, Notice of which was registered March 7, 1980 as Instrument No. LT105123, as amended by Agreement dated December 15, 1980, Notice of which was registered on March 31, 1981 as Instrument No. LT121877 between Eaglebrook Investments Limited and Ballycroy Investments Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1185, Pickering. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 16th day of January, 1989. Wayne Ar~l~urs, Mayor Br6ce Taylor, Cler'k RELEASE AND DISCHARGE WHEREAS the Agreement dated June 5, 1978, Notice of which was registered March 7, 1980, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT105123, between, EAGLEBROOK INVESTMENTS LIMITED and BALLYCROY INVESTMENTS LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", as amended by the Agreement dated December 15, 1980, Notice of which was registered on March 31, 1981, in that Office as Instrument No. LT121877, provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement as amended have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessor and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of both Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 10, inclusive, Blocks 11 to 20 inclusive and the Street - Hampton Court, on Plan M-1185, Picketing. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers.
