HomeMy WebLinkAboutBy-law 2987/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2987/g9 Being a by-law to assume services under the jurisdiction of the Town in Plan M-1185, Pickering. WHEREAS, pursuant to, where applicable, the Municipal Act, R.S.O. 1980, c.302, ss.259, 284, 286, 298 and 315.7; the Planning Act, 1983, s.o. 1983, c.1, s.50; the Regional Municipality of Durham Act, R.S.O. 1980, c.434, ss.34 and 53, and the Agreement dated June 5, 1978 (Notice of which was registered on March 7, 1980 as Instrument No. LT105123), between Eaglebrook Investments Limited and Ballycroy Investments Limited and The Corporation of the Town of Picketing, aboveground and underground services under the jurisdiction of the Town in Plan M-1185, Pickering, have been completed to its satisfaction; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: I. The aboveground services under the jurisdiction of the Town, that are required to be constructed or installed in the development of Plan M-1185, Pickering, including the roads, curbs and gutters, sidewalks, driveway aprons, boule- vards, street signs, fencing and grading, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan M-1185, Pickering, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of December 1, 1987. 2. The underground services under the jurisdiction of the Town that are required to be constructed or installed in the development of Plan M-1185, Picketing, including the storm drainage system and related appurtenances, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan M-1185, Picketing, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of August 20, 1984. 3. In sections 1 and 2, the phrase "lands that are ... owned by the Town" includes lands that are subject to an easement transferred to the Town, but only with respect to the specific service or services referred to in the easement transfer document. SO; the Regional Municipality of Durham Act, R.S.O. 1980, c.434, ss.34 and 53, and the Agreement dated June 5, 1978 (Notice of which was registered on March 7, 1980 as Insirument No. LT105123), between Eaglebrook Investments Limited and Ballycroy Investments Limited and The Corporation of the Town of Pickering, aboveground and underground services under the jurisdiction of the Town in Plan M--1185, Pickering, have been completed to its satisfaction; NOW THEREFORE, the Council of The Corporation of the Town of Pickering IIEREBY ENACTS AS FOLLOWS: 1. The aboveground services under the jurisdiction of the Town, that are required to be constructed or installed in the development of Plan M-1155, Pickering, including the roads, curbs and gutters, sidewalks, driveway aprons, boule- vards, street signs, fencing and grading, located on lands that are both. (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan M-I185, Picketing, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of December 1, 1987. 2. The underground services under the jurisdiction of the Town that are required to be constructed or installed in the development of Plan M-1185. Pickering, including the storm drainage system and related appurtenances, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality o( Uurham or the Province of Ontario, and (b) in Plan M-1155, Pickering, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for maintenance, as of August 20, 1984. 3. lit sections 1 and 2, the phrase "lands that are ... owned by the Townu includes lands that are subject to an easement transferred to the Town, but only with respect to the speciffk service or services referred to in the easement transfer document. The aboveground services under the jurisdiction of the Town, that are required to be constructed or instaIIed in the developmen~ of Plan M-1185, Picketing, including the roads, curbs and gutters, sidewalks, driveway aprons, boule- vards, street signs, fencing and grading, located on lands that are both, (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and (b) in Plan M-1185, Pickering, or immediately adjacent thereto, are hereby accepted by the Town and assumed by it for mainteoance, as of December ], 1987. 2. The underground services under the jurisdiction of the Town that are required to be constructed or installed in the development of Flan M-1185, Pickering, including the storm drainage system and related appurtenances, located on lands that are both, I~ (a) dedicated to or owned by the Town, the Regional Municipality of Durham or the Province of Ontario, and ,, (b) in Plan M-1]85, Pickering~ or immediately adjacent thereto, ,, '1 are hereby accepted hy the Town and assumed by it for maintenance, as of !
