HomeMy WebLinkAboutBy-law 2969/88THE CORPORATION UF ThfE 7OWN OF PICKERING BY-LAW NUMBER 2969/88 Being a Zoning 6y-law to amend 6y-law 2497/87, which amended Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area in Part of Lot 19, Plan 230, in the Town of Pickering. (A 27/87) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 2497/87, amending By-law 3036, to permit the establishment of restricted light industrial uses and a greenbelt-conservation area in Part of Lot t9, Plan 230; AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to amend 6y-law 2497/87 to also permit the development of offices, financial insiitutions, restaurant-type A, furniture and major appliance stores, home improvement centres, light machinery and equipment supplier and a rental establishment in Part of Lot 19, Plan 230; N0�4 THEKEFOKE THL COUNCIL OF THE CORPORATION OF THE TOWN OF PICKEl2ING HEREBY ENACTS AS FOLLOWS; A. TEXT AMENDMENTS Section 4 of 6y-law 2497/87 is hereby amended by adding thereto the following definitions: (22) "LiRht Machinery and Equipment Supplier" shall mean a building or a part of a building in which office furniture and machines, carpet and drapery cleaning equipment, painting, gardening and plumbing equipment, small hand and power tools and similar products are stored, offered or kept for wholesale or retail sale to industrial or commercial establishments; (23) °Rental Esiablishment" shall mean a building or part of a building in which goods, wares, merchandise, substances, articles or things are offered or kept for offer for rent directty to the public; 2. Section 5 of I3y-law 2497/87 is hereby amended by adding thereto the following subsection: (4) Special Re�ulations ("15G27)" Symbol) On lands where the "Ml-8" designation on Schedule I attached hereto is followed by the syrn�ol °(SC-27)", the following regulations shall appty: (a) In addition to the uses specified in section 5(1) of this By-law, the following uses shall be permitted: (i) (ii) (iii) (iv) (v) (vi) (vii) (vii) business office financial institution furniture or major appliance store home improvement centre light machinery and equipment supplier professional office rental esiablishment restaurant-type A (b) All zone requirements specified in section 5(2) of this By-law shali apply except that if one or more of the uses listed in section 5(4)(a) of this By-law are esiablished: � r � �.� � /j � � � -2- (i) Sections 5(2)(a) and 5(2)(d) shall not apply to the lands designated "Nil-8(SG27)" on Schedule I hereto; lii) Despite section 5l2)ij)�ii), for all uses listed in sections 5(4)(a) and 5(1) of this By-law there shalt be provided and maintained on the lot a minimum of 5 parking spaces per 100 square metres gross leasable floor area; (iii) Despite the provisions of section 5(2)(f), if such yard abuts Highway No, 401, the minimum rear yard depth shall be 14 metres; (c) (i) The aggregate of the gross leasable floor areas of all restaurants-type A, shall not exceed 250 square metres; (ii) No more than one restaurant-type A shall be permitted within a building located on a lot within the lands designated °h41-8(SC-27)" on Schedule I hereto; (d) The gross leasable floor area of each furniture or major appliance store, home improvement centre and light machinery and equipment supplier shall not be less than 278 square metres; (e) The aggregate of the gross floor areas of all buildings on the lot shall not exceed 700 square metres; (f) 1'he location of the point of access to the lands designated "UI-8(SG27)" on Schedule 1 hereto shall be restricted to that area designated "access" on Schedule 1 hereto. [3. SCHEDULE AMENDMENT Schedule I to 6y-law 2497/87 is hereby amended by changing from "MI-8" to "M1-8(SC-27)" the zone designation of the lands designated "Ml-8(SC-27)" on Schedule lattached hereto. C. BY-LAW 2447/87 By-law 2497/87 is hereby amended only to the extent necessary to give effect to the provisions of this By-law. Definitions and subject matter not specifically dealt with in this 8y-law shall be governed by the relevant provisions of By-law 2497/87 and 13y-law 3036, as amended. D. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal 6oard, if required.
