HomeMy WebLinkAboutBy-law 2923/88THE CORPORATION OF THE TOWN OF PICKERING 6Y-LAW NUMBER 2923/88 Being a By-law to amend By-law 2498/87, which amended Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area in Part of Lots 25 & 26, Range 3, Broken Front Concession and Part of Lots 25 and 26, Concession 1 in the Town of Pickering. (A 54J87) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 2498/87, amending By-law 3036, to permit the establishment of a local central area comprising various commercial establishments and offices on Part of Lots 25 and 26, Range 3, Broken Front Concession, and Part of Lots 25 and 26, Concession 1; AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to amend By-law 2498/87 to also permit the development of a financial institution, restaurant - type A and a vehicle repair or rental establishment; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. Schedule I to By-law 2498/87 is hereby amended by adding thereto that portion of the Canadian National Railway right-of-way designated as "SC-26" on Schedule I hereto and by changing from "SC-l2" to "SC-26" the zone designation of the balance of the lands designated "SC-26" on Schedule I hereto. 2. Schedule !I to this By-law is hereby added to By-law 2498/87 as Schedule [I thereto. 3. Section 2 of By-law 2498/87 is hereby amended by deleting the term ' and "SC-13" ' from the fourth line and by substituting the term '"SC-13" and "SC-26" ' therefor. 4. Section 4�25) of By-law 2498/87 is hereby renumbered to 4(27). 5. Section 4 of By-law 2498/87 is hereby amended by adding thereto the following definitions: (25) "Vehicle Repair Shop" shall mean an establishment containing facilities for the repair and maintena�ce of vehicles on the premises, in which vehicle accessories are sold and vehicle maint�nance and repair operations are performed in return for remuneration, but shall not include a body shop or any establishment engaged in the retail sale of vehicie fuels; (26) "Vehicle Sales or Rental Establishment" shall mean an establishment used for the sale, service, rent or lease of vehicles and which may include as an accessory thereto the outdoor display of vehicles for sale, rent or lease and a vehicle repair shop, but shall not include any establishment engaged in the retail sale of motor vehicle fuels; -2 - 6. Section S of By-law 2498/87 is hereby amended by adding thereto the following subsection: (4) (a) Uses Permitted ("SG26" Zone) No person shall within the lands designated "SC-26" on Schedu(e I attached hereto use any lot or erect, alter or use any building or struct�re for any purpose except the following: (i) business office (ii) financial institution (iii) professional office (iv) restaurant - type A (v) vehicle repair shop (vi) vehicle sales or rental establishment (b) Zone Requirements ("SC-26° Zone) No person shall within the lands designated "SC-26" on Schedule 1 attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (i) BUILDING SETBACKS (minimum): as illustrated on Schedule it (ii) 6UILDING HEIGHT (maximum) �.5 metres except in the area cross hatched on Schedule II wl�ere a building height (maximum) shall be l5 metres (iii) OPEN STOl2AGE: no open storage shall be permitted (iv) PARKING REQUIREMENTS: A For the purpose of this ciause "parking space" shall mean a usable and accessible area of not less than 2.6 metres in width and 5.3 metres in length for the temporary parking of a vehicle, but shall noi include any portion of a parking aisle or driveway; B There shall be provided and maintained on the lands designated "SC-26" on Schedule I, 1. where the only use on the lands is a vehicle sales or rental establishment, a minimum of 2.7 parking spaces for each 100 square metres or part thereof of gross floor area, or 2. where there is any use other than a vehicle sales or rental esiablishment on the lands, a minimum of 225 parking spaces, regardless of gross floor area, but not both 1 and 2. C No parking space as required by paragraph B of this Section may be used for yehicle display; D Sections 5.21.2a) and 5.21.2b) of By-law 3036, as amended, shall not apply to the lands designated "SC-26" on Schedule I attached hereto; � E All parking areas shall be set back a minimum of 3.0 metres from all road allowances; F Despite Section 5.2L2g) of By-law 3036, as amended, all parking areas shall be surfaced with brick, asphalt or concrete, or any combination thereof. - 3 - (v) SPECIAL PROVISIONS: A The aggregate of the gross floor areas of all buildings and structures on the lands designated "SG26" on Schedule [ shall not exceed 7,100 square metres; B The aggregate of the gross floor areas of all resiaurants - type A, on the lands designated shall not exceed 400 square metres; 7. This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TI�hE THIS l�th DAY OF october , 1988.
