Zg'75188 Being a by-law to stop-up and close Penny Lane, Plan M-997, Pickering and to authorize the sale of parts thereof and of Block XH, Plan M-997, Pickering, to the abutting owners. WHEREAS, pursuant to the provisions of sections 298(1) and 316(1) of the Municipal Act, R.S.O. 1980, chapter 302, the council of any municipality may pass by-laws to stop-up a highway or part thereof and to authorize its sale or the sale of a part thereof at a fixed price; and WHEREAS, notice of this by-law has been published once a week for four consecutive weeks and the provisions of the Act relating to the stopping-up of a highway have been complied with; and WHEREAS, pursuant to the provisions of section 193 of the Act, the Council of any municipality may pass a by-law to dispose of Block XH, Plan M-447, Pickering, as it is no longer required; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. � 3 (1) Penny Lane, Plan M-997, Pickering, is hereby stopped-up and closed to vehicular and pedestrian traffic. (1) Those parts of Penny Lane, Plan M-997, Pickering, designated as Parts Z and 3, Plan 40R-10192, together with that part of Block XH, Plan M-997, Pickering, designated as Part 1, Plan 40R-10192, shal] be offered for sale to the abutting owner to the south, subject to an easement in favour of the Regiona] Municipality of Durham over Parts 1 and 2, Plan 40R-10192, for the sale price of $1,386.00. (2) Those parts of Penny Lane, Plan M-997, Pickering, designated as Parts 7, 8 and 10, Plan 40R-10192, together with those parts of Block XH, Plan M-997, Pickering, designated as Parts 6 and 9, Plan 40R 10192 shall be offered for sale to the abutting owner to the north, subject to an ease- ment in favour of the Regional Municipality of Durham over Parts 6 and 7, Plan 40R-10192, for the sale price of $55,726.00 (1) The offers referred to in section 2 shall be made by the Town on or before December 2, 1988. (2) The period within which an abutting owner may exercise his right to purchase the lands offered to him shall commence at 9:00 a.m. on Decem- ber 5, 1988 and end at 4:00 p.m. on December 16, 1988. BY-LAW read a first and second time this 19th day of September, 1988. BY-LAW read a third time and finally passed this 21st day of November, 1988.
