HomeMy WebLinkAboutBy-law 2872/88THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO.2872 /88 Being a by-law to assume part of Front Street and part of Bay Street, Plan 65, Pickering, for public use as public highways under the jurisdic- tion of the Town (Parts 1-4, Plan 40R-8508). WHEREAS Front Street and Bay Street are highways shown on a plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public highways; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Pickering has jurisdiction over those highways (the Council of the Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add those highways to the regional road system); and WHEREAS pursuant to the Municipal Act. s.258, the soil and freehold of those high- ways is therefore vested in The Corporation of the Town of Pickering; NOW THEREFORE the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The following highways are hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Pickering: (a) that part of Front Street, Plan 65, designated as Part 1, Plan 40R-8508, and (b) that part of Bay Street, Plan 65, designated as Parts 2, 3 and 4, Plan 40R-850S, in the Town of Pickering, Regional Municipality of Durham. BY-LAW read a first, second and third time and finally passed this 19th day of September 1988.
