HomeMy WebLinkAboutBy-law 2825/88 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2825/88 Being a by-law to authorize the execution of an Agreement amending the Subdivision Agreement respecting Plan 40M-1509, Picketing, (Draft Plan 18T~79088; Phase 2A, Grand Oak Homes (Eastern Division) Inc. ) WHEREAS pursuant to the provisions of the Planning Act, 1983, S.O. 1983, chapter 1, section 50, The Corporation of the Town of Picketing entered into a Subdivision Agreement dated April 21, 1987 with Grand Oak Homes (Eastern Division) Inc. respecting the development of what is now designated as Plan 40M-1509 (Draft Plan 18T-79088; Phase 2A, Grand Oak Homes (Eastern Division) Inc.); NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute an Agreement, in the form attached hereto as Schedule A, amending the Subdivision Agree- ment dated April 21, 1987 between The Corporation of the Town of Picketing and Grand Oak Homes (Eastern Division) Inc. respecting Plan 40M-1509, Picketing (Draft Plan 18T-79088; Phase 2A, Grand Oak Homes (Eastern Division) Inc.). BY-LAW read a first, second and third time and finally passed this 27th day of June, 1988. BETWEEN: GRAND OAK HOMES (EASTERN DIVISION) INC. hereinafter called the '~Owner" OF THE FIRST PART, - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE SECOND PART. WHEREAS, by Agreement dated April 21, 1987, between the Owner and the Town, the Owner proposed to subdivide and register a plan of subdivision of part of Lot 20, Concession 2, Picketing, now being Plan Number 40M-1509, Picketing (Draft Plan 18T-79088, Phase 2A); and WHEREAS, it is deemed desirable to amend that Agreement in certain respects; NOW THEREFORE, THIS AGREEMENT WITNESSETH, that in consideration of the sum of Two Dollars ($2.00) paid by each Party to the other, receipt of which by each is hereby acknowledged, the Parties hereto agree as follows: 1. The lands affected by this Agreement are all of Blocks 61, 62, 63, 64, 65, 69, 70 and 72, both inclusive, Plan 40M-1509, Picketing. 2. In this Agreement, the term "Subdivision Agreement~' shall mean the Agreement dated April 21, 1987, between the Owner and the Town, Notice of which was registered December 22, 1987, as Instrument LT365114. The Owner is bound by all the terms and provisions of the Subdivision Agree- ment, as amended hereby. 4. (1) Subsection 1 of Section 5 of Schedule A to the Subdivision Agreement is hereby amended by deleting ~'Blocks 60 to 70 and 72 and 73~' from the first line thereof and by substituting "Blocks 60, 66, 67, 68 and 72~' therefor. (2) Items 2, 3, 4, 5, 6, 10, 11 and 12, of the Table in subsection 3 of that section are hereby amended by deleting U18T-79004(R)-N*~ from Column II of each and by substituting ~Plan 40M-1513'~ therefor in each case. (3) Subsection 5 of that section is hereby amended by deleting "Draft Plan 18T-79004(R), north M-Plan'~ from the third and fourth lines and by substituting "Plan 40M-1513, Pickering" therefor. Section 6 of that Schedule is hereby deleted and the following substituted for it: 6. BUILDING PERMITS - DELAYED APPLICATION Despite any other provisions of this agreement, the Owner shall not apply for a building permit for the construction of any building, (a) on any of Blocks 60, 66, 67, 68 and 73 until the provisions of section 5(1) of this Schedule have been complied with~ and (b) on any of Lots 15 to 22 and Blocks 60, 66, 67, 68 and 73, until the south M-Plan of Draft Plan IST-79004(R) has been registered. This Agreement and everything herein contained shall enure to the benefit of and be binding upon the Parties hereto, their successors and assigns.
