HomeMy WebLinkAboutBy-law 2761/88 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 2761/88 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended by By-law 1751/83, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham in Part of Lot 4, Concession 6, in the Town of Pickering.(A 3/87 ) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 1751/83 amending By-law 3037, to permit the establishment of a farm implement dealership use on the subject [ands, being Part of Lot 4, Concession 6, in the Town of Pickering; AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to amend Restricted Area (Zoning) By-law 3037, as amended by By-law 1751/83 to permit an automobile repair shop as a permitted use in addition to uses presently permitted on the subject property; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: I. SCHEDULE AMENDMENT Schedule "A" to By-law 3037, as amended, is hereby further amended by adding thereto the cross-hatching and related dimensions shown on Schedule I hereto. 2. TEXT AMENDMENT (l) Section 6.1.5.10 (l) of By-law 3037, as made by By-law 175l/g3, is hereby revoked and the following substituted for it: (1) For the purpose of this subsection the term: (a) "automobile repair shop" shall mean an establishment containing facilities for the repair and maintenance of vehicles on the premises, in which vehicle accessories are sold and vehicle maintenance and repair operations are performed in return for remuneration and which may include a body shop, shall not include any establishment engaged in the retail sale of vehicle fuels, or a vehicle sales or rental establishment; (b) "body shop" shall mean an establishment engaged in repairing or painting vehicle bodies; (c) "farm implement dealership" means an establishment where farm implements, equipment and accessories are stored, kept and offered for retail sale to the public and may include facilities for the repair and servicing of such implements, equipment and accessories; (d) "vehicle sales or rental establishment" shall mean an establishment used for the sale, service, rent or lease of vehicles and which may include as an accessory thereto the outdoor display of vehicles for sale, rent or lease and a vehicle repair shop, but shall not include any establishment engaged in the retail sale of motor vehicle fuels. (2) Section 6.1.5.10 of By-law 3037, as made by By-law 1751/83, is hereby amended by adding the following paragraph to it: (2a) Despite the provisions of this By-law, in addition to any other uses that may be permitted thereon, the lands designated "A(FID)" on Schedule I to By-law 1751/83 may be used for the purpose of an automobile repair shop in accordance with the following provisions: -2- (a) an automobile repair shop shall be permitted only on those lands cross-hatched on Schedule I to By-law 2761/88; (b) all vehicles awaiting repair, being repaired or awaiting removal having been repaired shall be located only on those lands cross-hatched on Schedule I to By-law 2761/88; (c) no more than 12 vehicles awaiting repair~ being repaired or awaiting removal having been repaired shall be located on those lands cross-hatched on Schedule I to By-law 2761/88. 8. EFFECTIVE DATE This By-la~v shall take e£fect from the day of passing hereof subject to the approval of the Ontario Municipal Board~ if required.
