HomeMy WebLinkAboutBy-law 2741/88 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 2741/88 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended, to implement the Olficial Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 24, Plan 12 (Parts 1, 2 & 3, Plan 40R-11108), in the Town of Picketing. (A ~0187) WHEREAS the Council of the Corporation of the Town o~ Picketing deems it desirable to re-align the zone boundaries on lands being Part of Lot 2#, Plan 12; AND WHEREAS an amendment to By-law 3037, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. BY-LAW 3037 By-law 3037, passed by the Council of the Corporation of the Township (now Town) of Picketing on the 3rd day of August, 196~5, and approved by the Ontario Municipal Board on the 10th day of November, 1966, and amended from time to time, is hereby further amended only to the extent necessary to give effect to the provisions of Sections 2 and 3 hereof. 2. SCHEDULE "A" AMENDMENT Schedule "A" to By-law 3037, as amended, is hereby further amended by changing from "R~" - Village Residential Zone and "MI" - Storage and Light Manufacturing Zone to "RS" - (Village Residential Zone) the zone designation of lands designated "R.5" on Schedule I attached hereto being Part of Lot 2t~, Plan 12 (Parts l, 2 and 3, Plan #0R-III08). 3. TEXT AMENDMENT Section 8 of By-law 3037, as amended, is hereby further amended by adding thereto the following subsection: 8.3.3 Part of Lot 24, Plan 12 (Parts 1, 2 & 3, Plan ~0R-IIi08) (1) Despite the provisions of Section 8.1 and 8.2 the following uses shall be permitted, but only when carried on within the building in existence on February 12, 1988 and shown on the lands hatched on Schedule I to By-law 2741/88; A service or repair shop, a warehouse or distributing depot, or a garage - commercial; Light manufacturing or assembly of manufactured products such as: (a) furniture and finished lumber products; (b) light metal products such as precision instruments, watches and radios. (2) For so long as the only building located on the lands hatched on Schedule I to By-law 2741/gg is the building shown thereon, (a) There shall be provided and maintained on the lands hatched on that Schedule a minimum of 5 parking spaces; and (b) Sections 5.19.2a), 5.19.2b) and 5.19.2k) of By-law 3037 shall not apply to the lands hatched on that Schedule. -2- (3) Section 8.1 of By-law 3037 shall not apply to the lands hatched on Schedule I to By-law 274]./88 so long as the building shown on that Schedule remains thereon. EFFECTIVE DATE This By-law shall take effect £rom the day o£ passing hereof subject to the approval oi the Ontario Municipal Board~ if required.
