WHEREAS The Corporation of the Town of Pickering requires storm sewer easements over Part Lots 25 and 26, Plan 40M-1488, Pickering (Parts 3 and 4, Plan 40R-10513) for the purpose of draining storm water and pursuant to the provisions of section 193 of the Municipal Act, R.S.O. 1980, chapter 302, a mur::'-ipal council may pass by-laws f'or acquiring interests in lands; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Transfer/Deed of Land, in the form attached hereto as Schedule A, from Grand Oak tlomes (Eastern Division) Inc. to The Corporation of the Town of Picker- lng, respecting storm sewer easements over Part Lots 25 ,and 26, Plan 40M-!488, Picketing (Parts 3 and 4, Plan 40R-108!3~. Cameron DATE: March 10, 1988 Legal Services Coordinator REPORT NUMBER: L 25/88 SUBJECT: Bramalea Limited - Block 109 and Part Lot 5, Plan 40M-1473, Picketing (Parts 1 and 2, Plan 40R-10908) - Transfer of Storm Sewer Easements RECOMMENDATION: A by-law authorizing the execution of a Transfer/Deed of Land from Bramalea Limited to the Town respecting storm sewer easements over Block 109 and Part Lot 5, Plan 40M-1473, Pickering (Parts 1 and 2, Plan 40R-10908), should be enacted. ORIGIN: Storm drainage design, Subdivision Plan 40M-1473, Picketing. AUTHORITY: Municipal Act, R.S.O. 1980, chapter 302, section 193. BACKGROUND: The Subdivision Agreement for the above-noted plan requires the owner of lands within this subdivision to install certain services, including storm sewers, and where necessary to provide to the Town, easements where such storm sewers are located. Such easements are required over Block 109 and Part Lot 5, Plan 40M-1473, Picketing, (Parts 1 and 2, Plan 40R-10908) and the developer has obtained those easements for the Town. The enactment of the draft by-law attached will authorize the execution of the Transfer/Deed of Land, which forms Schedule A to that by-law. ATTACHMENTS: 1.
