HomeMy WebLinkAboutBy-law 2601/87THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER2601 /87 Being a by-law to amend By-law Number 2359/87 (Parking) Whereas the Council of the Corporation of the Town of Pickering enacted By-law Number 2359/87 on January 19, 1987 to provide for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the Corporation of the Town of Pickering and on private and municipal property; and Whereas it is deemed expedient to increase the penalties for the contravention of various sections of By-law Number 2359/87; Now Therefore the Council of the Corporation of the Town of Pickering hereby enacts as follows: 1. Sections 14(l) and 14(2) of By-law Number 2359/87 are hereby deleted and the following is substituted therefor: 14. PENALTIES (1) Every person who contravenes this by-law is guilty of an offence and on conviction is liable to a fine of, (a) Ten Dollars ($10.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (5)(k) of section 3 of this by-law; (b) Fifteen Dollars ($15.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (5)(b) or (5)(h) of section 3; or section 5 of this by-law; (c) Twenty-five Dollars ($25.00) for each offence, exclusive of costs, where the contravention is of any of the provisions of subsections (1), (2), (3), (4), (6), (8) or (9) of section 3; subsections (5)(al, (c), (d), (el, (fl, (gl, (il, (j), (1) or (m) of section 3; section 4; section 6; section 7; subsections (3), (4), (5), (6), (8) or (9) of section 8; subsections (2), (3) or (4) of section 9; section lO; or section 13 of this by-law; (d) Fifty Dollars ($50.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (7) of section 3 of this by-law; (e) Seventy-five Dollars ($75.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (4) of section 12 of this by-law; (fl A maximum of Two Thousand Dollars ($2,000.00) for each offence, exclusive of costs, where the contravention is of any of the provisions of subsection (2) of section 12 of this by-law; recoverable under the provisions of the Provincial Offences Act. (2) The owner of a vehicle that is parked, stopped or left standing, as the case may be, in contravention of this by-law is guilty of an offence and on conviction is liable to a fine of, (a) Ten Dollars ($10.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection {5)(k) of section 3 of this by-law; {b) Fifteen Dollars ($15.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (5)(b) or (5)(h) of section 3; or section 5 of this by-law; (c) Twenty-five Dollars ($25.00) for each offence, exclusive of costs, where the contravention is of any of the provisions of subsections (1), {2), (3), (4), (6), {8) or {9) of section 3; subsections (5)(a), (c), (d), (e), (f}, (g), (i}, (j}, (1) or (m) of section 3; section 4; section 6; section 7; subsections (3), (4), (5), (6), (8) or (9) of section 8; subsections (2), (3) or (4) of section 9; section 10; or section 13 of this by-law; (d) Fifty Dollars {$50.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (7) of section 3 of this by-law; (e) Seventy-five Dollars ($75.00) for each offence, exclusive of costs, where the contravention is of the provisions of subsection (4) of section 12 of this by-law; recoverable under the provisions of the Provincial Offences Act, unless the owner proves to the satisfaction of the Court that at the time of the offence, the motor vehicle was in the possession of another person without the owner's consent, express or implied. This by-law shall take effect on January l, 1988. By-law read a first, second and third time and finally passed this 26th day of October, 1987. C 1 erk /
