Lewis Part of Lot 28, Plan 228 (1437 - 1439 Rougemount Drive) City of Picketing A final draft amending by-law has been prepared for the above-noted Zoning By-law Amendment Application. The draft by-law is attached for the consideration of City Council at their meeting scheduled for August 8, 2000, provided Council approves the application at its meeting earlier on August 8th. A Statutory Public Meeting was held for this application on June 15, 2000. The purpose and effect of this by-law is to rezone the subject property from "R3" to "R4". The proposed zoning will permit the severance of the subject property into two lots with frontages of 15.0-metres. I~ecto~& Development /gm Enclosure THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5722/00 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Picketing District Planning Area, Region of Durham in Part of Lot 28, Plan 228, in the City of Pickering. (A 13/00) WHEREAS the Council of the Corporation of the City of Picketing passed By-law 2912/88, on October 11, 1988, amending By-law 3036, as amended, to amend certain development provisions applicable to the subject lands, in the City of Pickering; AND WHEREAS the Council of the Corporation of the City of Picketing now deems it desirable to amend By-law 3036 as amended by By-law 2912/88, to rezone certain lands from "R3" (Residential Third Density Zone) to "R4" (Residential Fourth Density Zone) and "OS-HL" (Open Space/Hazard Lands); NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF' PICKERING HEREBY ENACTS AS FOLLOWS: 1. SCHEDULE Schedule "A" of By-law 3036 is hereby further amended by changing from "R3" (Residential Third Density Zone) to "R4" (Residential Fourth Density Zone) and "OS-HL" (Open Space/Hazard Lands), the zone designation of the lands designated "R4" and "OS-HL" on Schedule I attached hereto, being Part of Lot 28, Plan 228, City of Picketing. TEXT AMENDMENT (1) Section 9.3.3.6 of By-law 3036, as added by By-law 2912/88 and amended by By-law 3707/91, is hereby amended by adding thereto the following subsections: (v) OPEN SPACE/HAZARD LANDS ("OS-HL" Zone) A Uses Permitted ("OS-HL" Zone) No person shall within the land designated "OS-HL" on Schedule I attached hereto, use any land for any purpose except the preservation and conservation of the natural environment, soil and wildlife. B Zone Requirements ("OS-HL" Zone) No buildings or structures shall be permitted to be erected, nor any existing buildings or structures be modified or changed, nor shall the placing or removal of fill be permitted, except where buildings or structures are used only for purposes of flood and erosion control. C Special Regulations ("OS-HL" Zone) Notwithstanding Section 9.2.3, any residential dwelling or part thereof shall be located no less than 10.0 metres from the zone designation of lands designated "OS-HL" on Schedule 'T' attached hereto. (2) Section 10.3.6 of By-law 3036, as added by By-law 2912/88 and amended by By-law 3707/91, is hereby amended by adding thereto the following subsections: (v) OPEN SPACE/HAZARD LANDS ("OS-HL" Zone) A Uses Permitted ("OS-HL" Zone) No person shall within the land designated "OS-HL" on Schedule I attached hereto, use any land for any purpose except the preservation and conservation of the natural enviroment, soil and wildlife. BY-LAW 3036 By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 3036, as amended. 4. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof. BY-LAW read a first, second, and third time and finally passed this 8th day of August ,2000.
