HomeMy WebLinkAboutBy-law 5661/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5661/00 Being a by-law to assume Major Oaks Road, Greenmount Street and Denvale Drive, Plan 40M-1510, Pickering, for public use as public highway under the jurisdiction of the City. WHEREAS, Major Oaks Road, Greenmount Street and Denvale Drive, are highways shown on a plan of subdivision and is therefore deemed, pursuant to the Surveys Act, R.S.O. 1990, chapter S.30, section 57, to be public highway; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, section 263, the Council of The Corporation of the City of Picketing has jurisdiction over that highway (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipalities ./let, R.S.O. 1990, chapter R.8, section 23, to add that highway to the regional road system); and WHEREAS, pursuant to the Municipal Act, section 262, the soil and freehold of that highway is therefore vested in The Corporation of the City of Picketing; NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY ENACTS AS FOLLOWS: The following highway is hereby assumed for public use as public highway under the jurisdiction of the Council of The Corporation of the City of Pickering: Major Oaks Road Greenmount Street Denvale Drive according to Plan 40M-1510, City of Picketing, Regional Municipality of Durham. The City Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1990, chapter L.5, section 152, to have the Corporation entered as the owner of the highway referred to in section 1.
