HomeMy WebLinkAboutBy-law 5629/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5629/00 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended by By-law 2677/88, to implement the Official Plan of the City of Picketing District Planning Area, Region of Durham in Part of Lot 24, and Lots 25, 26 & 27, Plan 21 (Parts 5 and 6, 40R-1139) in the City of Piekering. (A 7/99) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 2677/88, amending Zoning By-law 3037, to permit development of residential, commercial, church, community, agricultural and greenbelt uses in Part of Lot 30, 31, 32 and 33, Concessions 4 and 5, in the Town of Picketing; AND WHEREAS the Council of the Corporation of the City of Picketing now deems it desirable to amend By-law 2677/88 to Zoning By-law 3037, to permit the redevelopment of a vacant heritage structure for residential and small-scale commercial uses; AND WHEREAS an amendment to By-law 2677/88 to Zoning By-law 3037, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENTS (1) Section 2 (Area Restricted) is amended by inserting the symbol "HMC9" following the symbol "G". (2) (3) Section 4 (Definitions) of amending By-law 2677/88 is hereby amended by renumbering subsections (1) to (15) and by adding the following definitions thereto: (13) "Retail Store" shall mean a building where goods, wares, merchandise, substances, articles or things are stored, offered or kept for retail sale to the public; (14) "Small Implement Repair Shop" shall mean a building where small implement equipment, such as domestic pumps and rotor tillers, are serviced, repaired or stored and may include the sale of used implements only; Section 5. (Provisions) is amended by adding the following subsection: (8) (a) Uses Permitted ("HMC9" Zone) No person shall within the lands designated "HMC9" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure for any purpose except the following: (i) (ii) (iii) dwelling unit; retail store; small implement repair shop. Co) -2- Zone Requirements ("HMC9" Zone) No person shall within the lands designated "HMC9" on Schedule I attached hereto use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (i) FRONT YARD DEPTH (minimum): 9.0 metres (ii) INTERIOR SIDE YARD WIDTH (minimum): 1.8 metres (iii)FLANKAGE SIDE YARD WIDTH (minimum): 1.8 metres (iv) REAR YARD DEPTH (minimum): 9.0 metres (v) LOT COVERAGE (maximum): 33 percent (vi) BUILDING HEIGHT (maximum) 18 metres (vii)OPEN STORAGE: no open storage shall be permitted in any yard (viii) PARKING REQUIREMENTS: A For the purpose of this clause, "parking space" shall mean a usable and accessible area of not less than 2.6 metres in width and 5.3 metres in length, for the temporary parking of a vehicle, but shall not include any portion of a parking aisle or driveway; B There shall be provided and maintained on the lot a minimum of 3.0 parking spaces per 100 square metres of gross leasable floor area for any retail store and small implement repair shop; C There shall be provided and maintained on the lot a minimum of two parking spaces for any dwelling unit; D Subsections 5.19.2 a), 5.19.2 b) and 5.19.2 k) of By-law 3037, as amended, shall not apply to the lands designated "HMC9" on Schedule I. (ix) SPECIAL PROVISIONS: (a) The gross floor area of ail retail uses shall be limited to a maximum of 400 square metres on the ground floor only; Co) A maximum of one dwelling unit is permitted on the property; (c) Small engine repairs are to be conducted from an accessory structure only; (d) The maximum gross floor area of all buildings on the lot shall not exceed 1700 square metres; -3- (e) Despite the provisions of Section 5.18 (a) (Accessory Buildings and Uses), By-law 3037, an accessory building may be located in any yard provided it has a minimum front yard depth of 7.5 metres and complies with all other yard requirements of Section 8. (b) of this By-law; (t) Despite the provisions of Section 5.18 (a) and (b) (provisions for accessory structure location) and Section 8.(b)(ix)(e) above, an accessory, detached garage may be located in the rear yard a minimum of 0.0 metres from the rear and side lot lines. (x) REMOVAL OF "(H)" HOLDING SYMBOL: Prior to an amendment to remove the "(H)" - Holding symbol preceding the zone category "HMC9", a Site Plan Agreement shall be entered into between the City of Picketing and the owner of the lands to which the "(H)" - Holding symbol applies, and registered on title to the lands described as Part Lot 24 and Lots 25-27, Plan 21 (Parts 5 and 6, 40R-1139). 2. SCHEDULE AMENDMENT Schedule I to By-law 2677/88, is hereby amended by deleting the symbol "HMC7", and inserting the symbol "(H)" on the land designated "HMC9" on the Schedule attached hereto. 3. BY-LAW By-law 3037, as amended by By-law 2677/88, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 3037, as amended by By-law 2677/88. 4. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
