HomeMy WebLinkAboutBy-law 4083/92 Tlrll~ CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 40 8 3/9 2 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement, and amendments thereto, respecting that part of Lot 28, Concession l, Pickering, now comprised of Plan M-1206, Pickering. WHEREAS, pursuant to the Planning Act, R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Township of Picketing and Bramalea Consolidated Developments Limited entered into an Agreement dated December 17, 1973, Notice of which was registered on March 5, 1976 as Instrument No. LTDI6542, which Agreement was subsequently amended by Agreements dated November 15, 1976 and December 11, 1978, respectively, Notices of which were registered on March 17, 1977 and January 2, 1979 as Instrument Numbers LTD39669 and LT83421, respecting the subdivision and development of that part of Lot 28, Concession 1, now comprised of Plan M-1206, Pickering; and WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A of: a) the Agreement dated December 17, 1973, Notice of which was registered March 5, 1976 as Instrument No. LTD16542; b) an Amending Agreement dated November 15, 1976, Notice of which was registered March 17, 1977 as Instrument Number LTD39669; c) an Amending Agreement dated December 11, 1978, Notice of which was registered January 2, 1979 as Instrument Number LT83421; respecting the subdivision and development of that part of Lot 28, Concession l, Pickering, now comprised of Plan M-1206, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a fixst, second and third time and finally passed this 21st day of September, 1992. Wayne Arth~u(s~ayor APPROVED /21~ruce Taylor, Clerk AS TO FORM [LEGAL DEPTi RELEASE AND DISCHARGE WHEREAS the Agreement dated December 17, 1973, Notice of which was ~egistered March 5, 1976, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LTDI6542, between, BRAMALEA CONSOLIDATED DEVELOPMENTS LllVl/TED of which BRAMALEA LIMITED is the successor hereinafter referred to as the "Company" THE CORPORATION OF THE TOWNSHIP OF PICKERING of which THE CORPORATION OF THE TOWN OF PICKERLNG is the successor hereinafter referred to as the "Town", as mended by Agreements dated November 15, 1976 and December 11, 1978, respectively, Notices of which were registered on March 17, 1977 and January 2, 1979, in that Office as Instrument Numbers LTD39669 and LT83421, provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of all three Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: That part of Lot 28, Concession 1, Pickering now comprised of Lots 1-39, inclusive, Block 40 and Woodruff Crescent, Plan M-1206, Town. of Picker'mg, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 21st day of September, 1992.
