HomeMy WebLinkAboutBy-law 4043/92 THE CORPORATION OF THE TOWN OF PICKER1NG BY-LAW NUMBER 4043/92 Bein~ a Zoning By-law to amend By-law 2497/87, which amended Restricted Area (Zomng) By-law 3036, as amended, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham, in Part of Lot 19, Plan 230, in the Town of Picketing. (A 14/91) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 2497/87, amending By-law 3036, to permit the establishment of restricted light industrial uses and a greenbelt-conservation area on lands being Part of Lot 19, Plan 230, Town of Picketing. AND WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 2969/88 which amended By-law 2497/87 to also permit the establishment of offices, financial institutions, restaurants - type A,. furniture and major appliance stores, home improvement centres, light machinery and eqm.p, ment suppliers and rental establishments on lands being Part of Lot 19, Plan 230, Town of P~ckering. AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to further amend By-law 2497/87, as amended, to also permit the establishment of commercial-recreation establishments, places of assembly, garden centres, vehicle sales or rental establishments, vehicle repair shops, food preparation plants, scientific, research or medical laboratories and non-venting dry cleaning establishments on lands being Part of Lot 19, Plan 230, Town of Picketing. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FO!-IDWS: 1. Section 4. of By-law 2497/87, as amended, is hereby further amended by adding thereto the following definitions: (26) "Commercial Recreation Establishment" shall mean a commercial establishment in which indoor recreational facilities such as bowling alleys, miniature golf courses, roller sk. ating rinks, squash courts, swimming pools and other similar indoor recreational facilities are provided and operated for ~nain or profit, and which may include an arena or stadium, but shall not clude a place of amusement or entertainment as defined herein; (27) "Food Preoarafion Plant" shall mean a building or part of a building in which processed-food produ, cts are cooked, baked, mixed, packaged or otherwise prepared for distribuuon to retail or institutional outlets; (28) "Games Arcade" shall mean any building, room, or area in which facilities are offered for the play of: (a) three or more games of chance; (b) three or more games of mixed chance and skill; (c) a combination of three or more games of chance and games of mixed chance and skill; for the amusement of the public, which games are not contrary to the Criminal Code of Canada, but does not include premises in which the only amusement facilities offered are pool tables, billiard tables, or bowling alleys; -2- (29) "Garden Centre" shall mean a building or part of a building in which hardware and garden su. pplies are stored, offered and kept for wholesale or retail sale, but shall not ~nclude food stores and neighbourhood stores; (30) "Place of Amusement or Entertainment" shall mean a building or part of a building in which facilities are provided for amusement or entertainment purposes, and which may include a billiard or pool room, a dance hall, a music hall, or a theatre, but shall not include a games arcade; (31)"Place of Assembly" shall mean a building or part of a building in which facilities are provided for civic, educational, recreational, political, religious or social meeting purposes, and may include facilities tor entertainment purposes such as musical and theatrical performances, but shall not include a place of amusement or entertainment; (32) "Sales Outle. t" shall mean a building or part of a building accessory to a light manufactunng plant, a food preparation plant, or a warehouse, wherein products are manufactured, produced, processed, serviced or repaired on the premises are kept or displayed for rent or for wholesale or retail sale, or wherein orders are taken for future delivery of such products. (33) "Scientific, Research. or Medical Laboratory" shall mean a building or part of a building whereto scientific, research, or medical experiments or investigations are systematically conducted, and where drugs, chemicals, ~lassware or other substances or articles pertinent to such experiments or investigations may be manufactured or otherwise prepared for use on the premises; (34) "Vehicle Repair Shop" shall mean an establishment containing facilities for the repair and maintenance of vehicles on the premises, in which vehicle accessories are sold and vehicle maintenance and. repair operations are performed in return for remuneration, but shall not include a body shop or any establishment engaged in the retail sale of vehicle fuels; (35) "Vehicle Sales or Rental Establishment" shall mean an establishment used for the sale, service, rent or lease of vehicles and which may include as an accessory thereto the outdoor display of vehicles for sale, rent or lease and a vehicle repair shop, bu.t shall not include any establishment engaged in the retail sale of motor vehicle fuels; 2. Section 5.(4)(a) of By-law 2497/87, as amended, is hereby further amended by adding thereto the following: (viii commercial recreation establishment (~l~ dry cleaning establishment - non-venting food preparation plant ((x.X.l garden centre place of assembly ~ii scientific, medical, or research laboratory [x~v vehicle repair shop (xv vehicle sales or rental establishment 3. Section 5.(4) of By-law 2497/87 is amended by adding thereto the following: (g) Sales outlets are permitted only if accessory to a light manufacturing plant, warehouse or food preparation plant, and providing the gross leasable floor area of the sales outlet does not exceed 20% of the gross leasable floor area of the light manufacturing plant, warehouse or food preparation plant. 4. BY-LAW 2497/lY'/ By-law 2497/87, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 2497/87, as amended, and By-law 3036, as amended. -3- EFFE~ DATE This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal Board, if required.
