HomeMy WebLinkAboutBy-law 4029/92 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO 4029/92 Being a by-law to attthorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plan 40M-1318, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Town of Picketing and J.F. Coughlan Construction Co. Limited entered into an Agreement dated May 7, 1984, Notice of which was registered on August 8, 1984 as Instrument No. LT211938, respecting the subdivision and development of Plan 40M- 1318, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated May 7, 1984, Notice of which was registered August 8, 1984 as Instrument No. LT211938, between J.F. Coughlan Construction Co. Limited and The Corporation of the Town of Pickering, respecting the subdivision and development of Plan 40M- 1318, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 15th day of June, 1992. COUgHLAN~C~QNSTR~[~_TI_ ON CO. LIMITED hereinafter referred to as the "Company" THE CORPORATION OF THE TOWN OF PICKERiNG hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-16, inclusive, Blocks 17-24, inclusive, Fawndale Road, Gwendolyn Street and Petunia Place, Plan 40M- 1318, Town of Picketing, Regional Municipality of Durham. 1N WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officelcs.
