HomeMy WebLinkAboutBy-law 3979/92 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3979/92 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plan 40M-1448, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P. 13, s.51, The Corporation of the Town of Picketing and Oarthwood Homes Limited entered into an Agreement dated June 30, 1986, Notice of which was registered on February 9, 1987 as Instrument No. LT309383, respecting the subdivision and development of Plan 40M-1448, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated June 30, 1986, Notice of which was registered February 9, 1987 as Instrument No. LT309383, between Ganhwood Homes Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan 40M-1448, Pickering. 2. Schedule A hereto forms part of this By-law. RELEASE AND DISCHARGE WHEREAS the Agreement dated June 30, 1986, Notice of which was registered Febnmry 9, 1987, h~ the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT309383, between, GARTI!_W~OD HOMES I~!MrrED hereinafter referred to as the "Company" T~HE CORP~)RAT!ON .Q~F THE TO_WN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, relea~ses and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursum~t to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-12, inclusive, Blocks 13 and 14 and Dahlia Crescent, Plan 40M-1448, in the Town of Pickering, in tbe Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 4th day of May, 1992.
