By-LAW NO. 3965/92
Being a by-law to authorize the execution of a Servicing
Agreement and to authorize the acquisition of lands
respecting the construction of a portion of Sideline 2
Road, Concession 7, Pickering (Karsten Corm'acting
Limited).
WHEREAS the owners of lands adjacent to an unopened section of Sideline 2 Road, Concession 7,
Picketing, wish to construct a roadway thereon at no cost to the Town for the purpose of obtaining
dedicated public access to their lands, and to that end Karsten Contracting Limited, representing those
owners, is prepared to enter into a Servicing Agreement with the Town pursuant to the Municipal Act,
R.S.O. 1990, chapter M.45, sections 263 and 284, respecting the construction thereof; and
(b) Municipal Act, R.S.O. 1990, chapter M.45, section 191.
WHEREAS the construction of that roadway will require the acquisition of certain lands adjacent to
Sideline 2 Road, Concession 7, Picketing; and
WHEREAS, pursuant to the provisions of the Municipal Act, R.S.O. 1990, chapter 302, section 193(1 ),
the Council of The Corporation of the Town of Picketing may pass by-laws for acquiring lands for the
purposes of the corporation;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Mayor mid Clerk are hereby authorized to execute a Servicing Agreement, in the form
attached hereto as Schedule A, between Karsten Contracting Limited and The Corporation of
the Town of Pickering, respecting the construction of a section of Sideline 2 Road, Concession
7, Pickering.
2. (1) The Corporation of the Town of Pickering shall acquire lands adjacent to Sideline 2
Road, Concession 7, Pickering, in accordance with section 6 of the Servicing
Agreement attached hereto as Schedule A, subject to the terms and conditions set out
therein, for road purposes.
(2) The Mayor and Clerk are hereby authorized to execute whatever documentation may be
necessary to effect any such acquisition of lands by The Corporation of the Town of
Pickering.
