HomeMy WebLinkAboutBy-law 3957/92 T__H_E {~ORI'ORATION OF THE TOWN OF PICKERINQ BY-LAW NO. 3957/92 Being a by-law to authorize the execution of a Release and Discharge of the Agreements respecting Platt 40M-1481, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P.13, s.51, or a predecessor thereof, The Corporation of the Town of Pickering and Robert Gordon entered into Agreements dated December 15, 1982 and May 19, 1987, Notices of which were registered on August 18, 1983 and August 13, 1987 as Instrument Numbers D162298 and LT343123, respecting the subdivision and development of Plan 40M4481, Picketing; and WItEREAS the terms and conditions of these Agreements have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: t. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreements dated December 15, 1982 and May 19, 1987, Notices of which were registered August 18, 1983 and August 13, 1987 as Instmmem Numbers D162298 and LT343123 between Robert Gordon and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan 40M- 148 l, Pickering. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third thne and finally passed this 23rd day of March, 1992. TOWN OF PtCKERING APPROVED [0 FORM LEGAL DEPT. RELF~$E AND DISCHARC~ WHEREAS tbe Agreements dated December 15, 1982 and May 19, 1987, Notices of which were registered August 18, 1983 and August 13, 1987, in the Land Registry Office for the Registry Division and the Land Titles Division of Durham (No. 40) as Instrument Numbers D162298 and LT343123, respectively, between, ROBERT GORDON_ hereinafter referred to as the "Developer" and - THEJT, Q~PORATION OF THE TOWN OF PICKERING " hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of these Agreements have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Developer, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Developer may have been, is, or may become subject to pursuant to the provisions of the Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-9, inclusive, and Blocks 10 and 11, Plan 40M-1481, in the Town of Picketing, in the Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 23rd day of March, 1992.
