HomeMy WebLinkAboutBy-law 4302/93 THE CORPORATION OF THE TOWN OF PICKERING I~Y-LAW NO. 4302/93 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plans 40M-1350 and 40M-1375, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P. 13, s.51, The Cor~.oration of the Town of Picketing and 370766 Ontario Limited entered into an Agreement dated April 6, 1985, Notice of which was registered on July 16, 1985 as Instrument No. LT238036, respecting the subdivision and development of Plans 40M-1350 and 40M-1375, Picketing: and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated Apr'il 6, 1985, Notice of which was registered on July 16, 1985 as Instrument No. LT238036, between 370766 Ontario Limited and The Corporation of the Town of Pickering, respecting the subdivision and development of Plans 40M-1350 and 40M-1375, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 4th day of August, 1993. RELEASE AND DISCHARGE WHEREAS the Agreement dated April 6, 1985, Notice of which was registered on July 16, 1985, in the Land Registt~ Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT238036, between, 370766 ONTARIO LIMITED hereinafter referred to as the "Company" THE CORPORATION OF THE TOW/q OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-59, inclusive, 62-74, inclusive, 77-98, inclusive, Blocks 99-117, inclusive and Blocks 123-128, inclusive, Plan 40M-1350, Town of Picketing, Regional Municipality of Durham; and Lots 1-14, inclusive, 16-29, inclusive, 31-146, Blocks 147-151, Maury Crescent, Sherman Crescent, Lynn Heights Drive and Escort Court, Plan 40M-1375, Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 4th day of August, 1993.
