BY-LAW NO. 4261/93
Being a by-law to authorize the execution of a Release
and Discharge of the Subdivision Agreement, and
amendments thereto, respecting Plan 40M-1383,
Pickering.
WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Town
of Pickering and Shipstate Ltd. entered into an Agreement dated July 2, 1985, Notice of which was
registered on January 13, 1986 as Instrument No. LT257275, respecting the subdivision and
development of Plan 40M-1383, Picketing, which Agreement was subsequendy amended by Agreement
dated December 17, 1990 (Notice of which was registered on January 22, 1991 as Instrument No.
LT534207); and
WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the
satisfaction of the Town;
NOW THEREFORE, the CouncLl of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form
attached hereto as Schedule A, of the Agreement dated July 2, 1985, Notice of which was
registered January 13, 1986 as Instrmnent No. LT257275, as amended by the Agreement dated
December 17, 1990, Notice of which was registered January 22, 1991 as Instrument No.
LT534207, between Shipstate Ltd. and The Corporation of the Town of Picketing, respecting
the subdivision and development of Plan 40M-1383, Picketing.
2. Schedule A hereto forms part of this By-law.
BY-LAW read a first, second and third time and finally passed this 21st day of June, 1993.

RELEASE AND DISCHARGE
WHEREAS the Agreement dated July 2, 1985, Notice of which was registered January 13, 1986, in the
Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT257275,
between,
SH1PSTATE LTD.
hereinafter referred to as the "Company"
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town",
as amended by the Agreement dated December 17, 1990, Notice of which was registered on January 22,
1991, in that Office as Instrument No. LT534207, provided for the subdivision and development of
lands affected hereby; and
WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the
satisfaction of the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and
assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind
whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions
of both Agreements.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1-30, inclusive, Plan 40M-1383, Town of Picketing, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly
authorized officers.
